AGE <br /> (715) 349-5957 2 4 3 0 1 J <br /> REGISTER OF DEEDS <br /> BURNETT COUNTY <br /> CERTIFIED SURVEY MAP <br /> SURVEYOR'S NOTES: <br /> (1) A 1-1/4" iron pipe was found located S62054126"E, 1 .01 feet from the 1" <br /> iron pipe that was set. The origin of this found monument is C.S.M. , Vol . 7, <br /> p.251 . With regard to locating the S.T.H. 70 right-of-way, the right-of-way <br /> was staked based on found monuments on the easterly right-of-way shown on <br /> C.S.M. , Vol. 9, p.103-5. The result is that the width of the right-of-way as <br /> specified on the right-of-way plat is ' maintained. There is room for <br /> considerable variation in determining the location of this right-of-way due to <br /> the following: the plat indicates a straight tangent, the actual centerline is <br /> not straight, and there are no right-of-way posts in this area. <br /> (2) The East-West Quarter Line of Section 15 was established as shown on <br /> C.S.M. , Vol. 9, p.103-5. A 1-1/4" iron pipe was found located SOO°00'06"E, <br /> 6.51 feet from the 1" iron pipe that was set. The origin of this found <br /> monument is shown on a survey filed in the Office of County Surveyor in RWBRF <br /> X126, P.83, and is labeled 1/4 Cor. Witness. It is my opinion that this <br /> monument was intended to be a witness only for the 1/4 corner position <br /> established on the ice and was not intended to be on the East-West 1/4 Line of <br /> Section 15. <br /> (3) Lot Areas: Lot No. Gross Area* Gross Area Contiguous <br /> (acres) (sq. ft.) Net Area* <br /> + 5.62 + 244700 213447 <br /> 2 + 5.65 + 246000 206234 <br /> * Gross Area extends to the High Water Mark and includes the Town Road <br /> Easement. Contiguous Net Area includes only that land lying east of <br /> the easterly limit of the Town Road Easement. <br /> (4) A Wisconsin Attorney General's Opinion (OAG 1-77) states, with references <br /> to several court cases, that tracts of land, separated by a public <br /> thoroughfare, do not constitute a single lot. The Subdivision Control <br /> Ordinance for Daniels Township states that no division of land resulting in a <br /> tract of land of less than 5 acres shall be created and that any part of a <br /> public private roadway shall be included as part of said 5 acres. The original <br /> title to the lands included on this map are continuous including the town road <br /> easement and lands between the town road easement and the lake. In a <br /> preliminary meeting with the Town Board, the consensus was that by making <br /> outlots of the lands between the town road easement and the lake, we would be <br /> creating new parcels which would be less than 5 acres. It is the intention and <br /> desire of all parties involved to have continuous title extending to the lake. <br /> (5) The easterly limit of the 66 foot wide town road easement is described as <br /> follows: Commencing at a 1-1/4" iron pipe at the intersection of the easterly <br /> right-of-way limit of the Old "35" town road easement and the North Line of <br /> Burnett County Certified Survey Map, Volume 7, page 251 ; thence N24°17'07"E, <br /> 195.55 feet; thence 154 .21 feet along the arc of a curve that is concave to <br /> the southeast, with a radius of 582.38 feet, a central angle of 15°10116" and a <br /> chord bearing N31°52'18"E for 153.76 feet to a 1" iron pipe monument; thence <br /> continuing 411 .31 feet along the arc of the same curve, with a radius of 582.38 <br /> feet , a central angle of 40°27'54", and a chord bearing N59°41'24"E for 402.81 <br /> feet; thence N79°55121"E, 76.90 feet; thence 137 .24 feet along the arc of <br /> curve that is concave to the northwest, with a radius of 673.00 feet, a central <br /> angle of 11°41'03", and a chord bearing N74°04149"E for 137 .01 feet to a point <br /> 171.35 feet west of the Northeast corner of Lot 2 of this map.
