RECORDING INFORMATION ONLY ABOVE THIS L I NO <br /> 1) Based on my research, observation and analysis, I have concluded that this is a natural navigable lake <br /> with attached wetland areas lying below the approximate ordinary high water mark of said lake. Each of the <br /> descriptions contained in deed document numbers 426931 and 426855 include the lakebed of this unnamed <br /> lake. This lake was shown graphically on the original General Land Office Plat in 1854 as what is presumed <br /> to be a navigable lake (being that it is graphically represented similar to other known navigable lakes versus <br /> what is typically shown as marsh or wetland on the original GLO plats). The entire shoreline of the existing <br /> lake includes low areas of wetland vegetation, making it difficult to determine the location of the ordinary <br /> high water mark. The approximate ordinary high water mark as shown on this survey is based on the location <br /> of the current water elevation together with observed vegetation evidence in the shore land area. The State of <br /> Wisconsin asserts that they hold title (in trust for the public) to those lands below the ordinary high water <br /> mark of all natural, navigable lakes within the state boundaries. Consult your attorney regarding title to <br /> lakebed areas included in your deed description. <br /> 2) The area of Lot I as shown and described in this survey does not include those lands lying below the <br /> approximate ordinary high water mark of the unnamed lake. For reference purposes and the sake of <br /> accountability, the area of the boundary of the original described parcel (see note 3 below) lying below the <br /> approximate ordinary high water mark has been shown on the face of the map. <br /> 3) Quit claim deed document number 426931 describes the south boundary of the parcel being described in <br /> said deed as "Commencing at the West Quarter corner of Section 30-38-17, thence south along the West <br /> Line of the Fr. NW SW for a distance of 300 feet, thence East parallel with the North Line of said SWI/4 for a <br /> distance of 1425 feet, more or less, to the East bank of existing lake shore, thence following lake shore <br /> northerly for a distance of 300 feet, more or less, to the North line of said SWI/4.......". Based on my review <br /> of an abstract of title for said parcel, it appears this description contained in said deed was originally <br /> created to be included as part of the description to define the lands conveyed in warranty deed recorded on <br /> May 2, 1979 in record book 335 page 601 with the Burnett County Register of Deeds. Said deed appears to be <br /> a conveyance between relatives. As noted in the above excerpt from the description, the location and <br /> bearing of the south line of this parcel as originally described is clearly defined but the easterly extent of <br /> the south line contains conflicting calls. The conflicting calls being a distance call of 1425 feet and a call to <br /> a natural monument which is the east bank of the existing lake shore. There is no additional record or <br /> apparent documented evidence that was provided to the surveyor to better define what was intended by the <br /> call to the "bank of the existing lake shore". However, in my opinion, the intent was to define the east edge <br /> of the parcel described in deed document number 426931 to be the east edge of the lake bed. See note <br /> regarding the lake bed. Consult your attorney regarding title to the area shown as lakebed on this map. <br /> Consult your attorney regarding riparian ownership and riparian rights along the easterly side of the lakebed <br /> as mapped. <br /> 4) Subsurface and environmental conditions were not surveyed, examined or considered as part of this <br /> survey. No statement is made concerning the existence of underground or overhead conditions, containers or <br /> facilities that may affect the use or development of this property other than what is shown on this map.
