BURNETT COUNTY ZONING ADMINISTRATION <br /> BURNETT COUNTY GOVERNMENT CENTER <br /> 7410 COUNTY ROAD K,#102 PHONE(715)349-2138 <br /> SIREN,WISCONSIN 54872 <br /> June 13,2003 <br /> Hazel Awtrey <br /> 897 Bahls Drive <br /> Hastings,MN 55033 <br /> RE: Request for Land Use Permit to repair Boathouse. <br /> Dear Mrs.Awtrey; <br /> This office has received and reviewed the Land Use Permit request for repair of your boathouse located at <br /> 28276 Dhein Road,in section 19,T40N R14W,Town of Scott. <br /> We are unable to approve this permit request based on the information submitted. Your contractor,Seven <br /> Eagles Corp.,has proposed that the 25%structural repair be determined as a percentage of the total linear <br /> length of the structure,which is indicated to be 64 feet 8 inches. The proposed repairs will replace 16 feet <br /> of wall. It appears that substantially more than that will need to be replaced to effect the repairs proposed, <br /> particularly on the western wall of the structure. In that location an area of two feet in length to be repaired <br /> is indicated,while a large crack appears to extend across about four feet of the wall's length. We will need <br /> the contractor to provide a detailed explanation as to how this will be accomplished while staying within <br /> the 25%limit of structural repair to a nonconforming structure as required under Section 4.4(9)(d)of the <br /> Bumett County Land Use Ordinance. <br /> An additional concern is jurisdictional in nature. The Boathouse is located so near(my assessment was at) <br /> the Ordinary High Water Mark of Birch Island Lake that it would be prudent for the County to visit the site <br /> with the Department of Natural Resources Water Management Specialist to ascertain if part of the <br /> Boathouse actually lies below the O.H.W.M.of the lake. If that is the case,the repair of the boathouse will <br /> fall into the jurisdiction of the Wisconsin Department of Natural Resources <br /> We will schedule a site visit with Ed Salminski,from WDNR to confirm County or State jurisdiction. <br /> Please have your contractor address the concerns regarding the determination of the amount of wall to be <br /> replaced,and the methods to be used. <br /> If you have any questions,contact this office anytime. <br /> Sincerely <br /> Craig Conroy <br /> Assistant Zoning Admin. <br />
