BURNETT COUNTY
LAND&WATER CONSERVATION DEPARTMENT
` ¢ ,
y$ 7410 County Road K,#109
•• , Siren,WI 54872
Telephone: (715)349-2186 Fax: (715)349-2102
LWC136 burnetteounty.org
www.bumettcounty.com
September 15, 2015
Jeffrey and Erica Smithers
1233 Mullan Ct.
St. Paul Park, MN 55071
Dear Mr.and Mrs. Smithers:
On August 7 I visited your Devils Lake property at the request of the Burnett County Zoning Department to assess the
condition of your shoreline for the purpose of determining whether it meets the Burnett County Shoreline Buffer
Standard. Staff from the Zoning Department also requested that I review the presence of a small retaining wall and
determine whether that is necessary to hold back a slope, within the bounds of the Burnett County Zoning Code.
Upon reviewing your file, I discovered you also had a required shoreline restoration in 2011,with a deadline of 2012.
It does not appear that you carried out this restoration. Your shoreline does not currently meet the standard for several
reasons. With the exception of the first 10 feet from the ordinary high water mark toward the upland, your access and
viewing corridor is 50 feet wide. This corridor can only be 30 feet wide. On both sides of the corridor where it is too
wide, you should plant 2 trees and 4 shrubs and stop any and all mowing and cutting outside of your viewing
corridor.
Also at the time of my site visit there was significant gully erosion occurring down the center of your view corridor.
The corridor must be stable and vegetated to meet the shoreline standard. You will have to smooth out this gully
erosion by raking, then seed it down with a lawn-type grass mix consisting mostly of Perennial Ryegrass and Creeping
Red Fescue. Once it is seeded down cover it with a one year photodegradable erosion control blanket and water it
thoroughly. Fall is an excellent time to plant grass seed.
I also reviewed the existing short retaining wall to see if it's necessary to hold back a slope. My determination was that
the wall is very short and not necessary to hold back a vertical face or steep slope, therefore it will have to be removed.
If you have any questions about the need for wall removal, please contact the Burnett County Zoning Administrator.
Once the short wall is removed, restore the area of bare soil using the same seeding recommendations listed above.
Staff from our office may spot check this required shoreline restoration some time during the 2016 growing season. If
you have any questions specific to carrying out your restoration, please do not hesitate to give me a call.
Sincerely,
Paul D. Cook
Conservation Specialist
