State of Wisconsin \ DEPARTMENT OF NhTURAL RESOURCES
NORTHWEST DISTRICT HEADQUARTERS
WISCONSIN P.O. Box 309
DEPT. OF NATURAL RESOURCES STH 70 West& First Street
Lc Spooner, Wisconsin 54801
TELEPHONETELEAX 715-6354105
June 17, 1993 -
JUN 23 '''" 3 3320
Mr. and Mrs. James Robinson
5549 Garden Dr.
Woodbury, MN 55125
Dear Mr. and Mrs. Robinson:
Re: Well Location Variance - Approval
The Department has received and reviewed a request for a variance to enclose an
existing well underneath a building addition. The well serves your lake home at
27390 Stone Gate Rd. in the Town of Oakland, in Burnett Co. , Wisconsin. The
legal description of the property is in Gov. Lot 2, Section 33, T4ON, R16W.
The Department is authorized by Chapters 144 and 162, Statutes, to have general
supervision and control over the waters of the state and to establish and enforce
standards and rules for obtaining drinking water and protecting public health
against polluted water supplies. Chapter NR 112, Wisconsin Administrative Code,
is adopted pursuant to that authority. Section NR 112.08(2) , Wis. Adm. Code,
states that no well shall be located, nor a building constructed, such that the
well casing pipe will terminate in or extend through the basement of any building
or terminate under the floor of a building having no basement. NR 112 also
states that every well shall be located so that it will be reasonably accessible
with proper equipment for cleaning, repair, testing, inspection and any other
maintenance that may be necessary.
According to the information provided, the 40 foot deep driven point well
presently terminates at least 12 inches above grade, with an above-ground
discharge to an offset jet pump and pressure tank. The well is proposed to be
located under a 16 x 20 ft. building addition, with the existing grade level in
the crawl space to remain at the same height as the surrounding grade.
Accessibility to the well will be provided through the floor of the addition and
an access door in the foundation of the crawl space. The pump and pressure tank
will either remain in the crawl space or the discharge from the well will extend
outside of the building and the pump and pressure tank will be enclosed in a
pumphouse structure.
The Department emphasizes that while a variance from ch. NR 112, Wisconsin
Administrative Code, requirements may be granted, compliance with ch. NR 112
requirements is recommended if at all possible. Chapter NR 112, Wis. Adm. Code,
requirements reflect measures which the Department has found to best protect
drinking water and groundwater from contamination. A Department-approved variance
does not guarantee acceptable water quality or quantity.
The Department has authority under s. NR 112.43, Wis. Adm. Code, to grant a
variance from ch. NR 112 requirements when strict compliance is impracticable.
Variance approval may be conditioned on compliance with comparable specifications
prescribed by the Department. Comparable specifications are based upon the need
to protect drinking water and groundwater from contamination.
Based on the information provided and the proposed construction of the building
addition, approval is hereby granted to allow the continued use of the well at
the above described property provided the following conditions are met.
x yobs
Paper
