The well serves your lake home at <br /> 27390 Stone Gate Rd. in the Town of Oakland, in Burnett Co. , Wisconsin. The <br /> legal description of the property is in Gov. Lot 2, Section 33, T4ON, R16W. <br /> The Department is authorized by Chapters 144 and 162, Statutes, to have general <br /> supervision and control over the waters of the state and to establish and enforce <br /> standards and rules for obtaining drinking water and protecting public health <br /> against polluted water supplies. Chapter NR 112, Wisconsin Administrative Code, <br /> is adopted pursuant to that authority. Section NR 112.08(2) , Wis. Adm. Code, <br /> states that no well shall be located, nor a building constructed, such that the <br /> well casing pipe will terminate in or extend through the basement of any building <br /> or terminate under the floor of a building having no basement. NR 112 also <br /> states that every well shall be located so that it will be reasonably accessible <br /> with proper equipment for cleaning, repair, testing, inspection and any other <br /> maintenance that may be necessary. <br /> According to the information provided, the 40 foot deep driven point well <br /> presently terminates at least 12 inches above grade, with an above-ground <br /> discharge to an offset jet pump and pressure tank. The well is proposed to be <br /> located under a 16 x 20 ft. building addition, with the existing grade level in <br /> the crawl space to remain at the same height as the surrounding grade. <br /> Accessibility to the well will be provided through the floor of the addition and <br /> an access door in the foundation of the crawl space. The pump and pressure tank <br /> will either remain in the crawl space or the discharge from the well will extend <br /> outside of the building and the pump and pressure tank will be enclosed in a <br /> pumphouse structure. <br /> The Department emphasizes that while a variance from ch. NR 112, Wisconsin <br /> Administrative Code, requirements may be granted, compliance with ch. NR 112 <br /> requirements is recommended if at all possible. Chapter NR 112, Wis. Adm. Code, <br /> requirements reflect measures which the Department has found to best protect <br /> drinking water and groundwater from contamination. A Department-approved variance <br /> does not guarantee acceptable water quality or quantity. <br /> The Department has authority under s. NR 112.43, Wis. Adm. Code, to grant a <br /> variance from ch. NR 112 requirements when strict compliance is impracticable. <br /> Variance approval may be conditioned on compliance with comparable specifications <br /> prescribed by the Department. Comparable specifications are based upon the need <br /> to protect drinking water and groundwater from contamination. <br /> Based on the information provided and the proposed construction of the building <br /> addition, approval is hereby granted to allow the continued use of the well at <br /> the above described property provided the following conditions are met. <br /> x yobs <br /> Paper <br />
