This letter is in response to your question <br /> regarding regulations pertaining to grooming your sandy shoreline on Devil's Lake in Burnett County. <br /> Due to my lack of familiarity with your property, I should first stress that this letter is not intended to serve <br /> as a letter of approval or permission to perform any specific activities along your shoreline. In many <br /> cases, permits or other approvals may be required for certain water-related activities in Wisconsin, so <br /> you'll want to check with the local DNR water management specialist (Ed Slaminski- 715-635-4097) as <br /> well as the county zoning administrator (Jim Flanigan- 715-349-2138) prior to commencement since they <br /> are most familiar with the applicable local regulations. That having been said, here are the relevant <br /> regulatory provisions that I am aware of: <br /> If you are planning to groom the exposed beach which is below the ordinary high water mark(OHWM), <br /> you may hand rake the area or use a push rototiller. It is recommended that you restrict the area <br /> "cleared" to a 30 foot window. It is important to note that riding tillers, ATVs, garden tractors, etc are <br /> prohibited as per s. 30.29, Wis. Stats. Also, any grading, filling, landscaping or removal topsoil from the <br /> bank of any navigable water in excess of 10,000 square feet requires a permit under ch. 30.19, Wis. <br /> Stats. You'll want to contact Ed for more information on these permits. <br /> If the area to be groomed is above the OHWM any activities must be in performed in compliance with <br /> Burnett County's shoreland zoning ordinance (i.e. the 30 foot viewing access corridor and buffer <br /> restrictions). If you are not familiar with the County provisions, it would be wise to contact them at the <br /> number listed above.
