The department supports the statements under the "Staff concerns to resolve" section of the <br /> County Staff Report for this request, and recommends including them as conditions of a <br /> granted permit, if one is granted. <br /> Please note that these comments are in regard to shoreland zoning only, and do not reflect <br /> applicable erosion control, waterway permitting, or other department regulations. <br /> Huppert Subdivision Variance Request <br /> Provided the LUIC finds the applicant has demonstrated meeting the three required variance <br /> criteria, the department supports the statements under the "Staff concerns to resolve" <br /> section of the County Staff Report for this request, and recommends including them as <br /> conditions of a granted variance, if one is granted. <br /> Additionally, regardless of the decision on the current request, the applicant should be <br /> required to demonstrate that the newer structure built without a dwelling permit does meet <br /> the 100-foot ordinary high water mark setback requirement (s. 30-504(1) and s. 30-509(d) of <br /> the Burnett County Code of Ordinances) .
