CROIX FALLS, WISCONSIN 54024 <br /> March 7, 1994 V <br /> Mr. Jim Flanagan V <br /> Burnett County Zoning Administration <br /> 7410 County Road K. #102 <br /> Siren, Wisconsin 54872 <br /> Dear Mr. Flanagan: <br /> We have been approached by Mr. Dan Fisher with regard to rebuilding a <br /> residence he owned in Burnett County which was destroyed by fire on <br /> November 25, 1993 . That residence, and the land on which it was located <br /> are both owned by the United States of America and are being managed by <br /> the National Park Service as a part of the St. Croix National Scenic <br /> Riverway. The background on this ownership is as follows. <br /> At the time of our acquisition all of this property was owned by Ralph <br /> and Jean Lener. By Order of the United States District Court for the <br /> Western District of Wisconsin, the United States acquired fee title to <br /> 12 .89 acres of the Lener's ownership (essentially a strip of land <br /> parallel to the river and approximately 400 feet deep, west to east) and <br /> a Scenic Easement (less than fee interest) over the back 27. 74 acres of <br /> their ownership. That order was dated March 15, 1991 and recorded in <br /> Burnett County on April 2, 1991 in Vol 466, page 467-474, as Document <br /> No. 269580 . A copy of the recorded document is enclosed herewith. <br /> As a part of the acquisition of the fee interest over the 12 .89 acres <br /> (which is identified in our records and in the court order as National <br /> Park Service Tract No. 45-120) the Leners elected to reserve a right of <br /> use and occupancy over the south 200 feet of Tract 45-120, including all <br /> improvements located thereon and the right to maintain and use the <br /> existing driveway and access road running across adjacent Tract 45-121 <br /> to the public road known as Ferry Road. The right to retain such a use <br /> and occupancy is provided for in Section 6(g) (1) (2) (3) of the Wild and <br /> Scenic Rivers Act which established the Riverway. A portion of our <br /> Segment Map is also enclosed which shows the location of Tracts 45-120 <br /> and 45-121 and the approximate location of the reserved area whih is on <br /> Tract 45-120 . <br /> By an "Assignment of Interest" recorded July 8, 1991 in Volume 470, <br /> pages 36-37, as Document No. 270831, only the Right of Use and Occupancy <br /> was transferred to Daniel William Fisher by the Leners. <br /> s 391 <br />
