♦ENT OFIM11L-
PyRDEM
W' ,tet^ wIWW-
United States Department of the Interior
NATIONAL PARK SERVICE
ST. CROIX NATIONAL SCENIC RIVERWAY
IN REPLY REFER TO: P.O. BOX 708 `'
r
ST. CROIX FALLS, WISCONSIN 54024
March 7, 1994 V
Mr. Jim Flanagan V
Burnett County Zoning Administration
7410 County Road K. #102
Siren, Wisconsin 54872
Dear Mr. Flanagan:
We have been approached by Mr. Dan Fisher with regard to rebuilding a
residence he owned in Burnett County which was destroyed by fire on
November 25, 1993 . That residence, and the land on which it was located
are both owned by the United States of America and are being managed by
the National Park Service as a part of the St. Croix National Scenic
Riverway. The background on this ownership is as follows.
At the time of our acquisition all of this property was owned by Ralph
and Jean Lener. By Order of the United States District Court for the
Western District of Wisconsin, the United States acquired fee title to
12 .89 acres of the Lener's ownership (essentially a strip of land
parallel to the river and approximately 400 feet deep, west to east) and
a Scenic Easement (less than fee interest) over the back 27. 74 acres of
their ownership. That order was dated March 15, 1991 and recorded in
Burnett County on April 2, 1991 in Vol 466, page 467-474, as Document
No. 269580 . A copy of the recorded document is enclosed herewith.
As a part of the acquisition of the fee interest over the 12 .89 acres
(which is identified in our records and in the court order as National
Park Service Tract No. 45-120) the Leners elected to reserve a right of
use and occupancy over the south 200 feet of Tract 45-120, including all
improvements located thereon and the right to maintain and use the
existing driveway and access road running across adjacent Tract 45-121
to the public road known as Ferry Road. The right to retain such a use
and occupancy is provided for in Section 6(g) (1) (2) (3) of the Wild and
Scenic Rivers Act which established the Riverway. A portion of our
Segment Map is also enclosed which shows the location of Tracts 45-120
and 45-121 and the approximate location of the reserved area whih is on
Tract 45-120 .
By an "Assignment of Interest" recorded July 8, 1991 in Volume 470,
pages 36-37, as Document No. 270831, only the Right of Use and Occupancy
was transferred to Daniel William Fisher by the Leners.
s 391
