Describe variance requested:_ <br /> Install a ten feet high chain link fence along the waterfront of the Wallace Resort, and along our <br /> entire lot line with Hamilton, (it is our undersatnding a variance is only required for the 75 feet at the <br /> waterfront), we intend to attach a fabric screen to that chin link fence to screen the extremely <br /> offensive view of items on these adjacent parcels and to end trespass on our property by Wallace <br /> Resort guests and to end vandalism and trespass by Hamilton. <br /> Describe current use and improvements (Ex. Residential/Recreation; Cabin/garage): <br /> This parcel is zoned RR-1 and is our riparian acces to Devils Lake. <br /> Provide description and location of all nonconforming structures and uses on the property: <br /> None <br /> Provide Burnett County Ordinance standard from which variance is being sought(section number and text): <br /> Article X, Fences, Sec. 45-191-Fences (a). Variance is to screen within 75 feet of OHWM. <br /> ARTICLE VII. - SCREENING AND FENCING, Sec. 30-607. -a.) Screenig of Objectional <br /> Views, d). public safety (from Hamilton trespass and vandalism) , e.) Suitable setting <br /> for particular use.) (2) "Such as..." is understood to not be strictly limited to examples <br /> shown. <br /> Alternatives: (To be completed by the applicant): <br /> Describe alternatives to your proposal such as other locations, designs, and construction techniques. Examples of <br /> alternatives would be: reducing the size of request,moving the structure to a different area, or expanding upward instead <br /> of laterally. Attach a site map showing alternatives you considered in each category below. <br /> a. Alternatives you considered that comply with existing standards. If you find such an alternative,you can move <br /> forward with this option with a regular permit. If you reject compliant alternatives, provide the reasons you <br /> rejected them. <br /> Wallace privy does not have a legal Sanitary Permit and therefore is understood to be <br /> polluting. Wallace privy is 10 feet from the Chelmo lot line and does not meet the county <br /> setack of 25 feet. Wallace has water on their property and we contend they should be required <br /> to have flush toilets. We should not have to look at cars parked at the lake. <br /> Hamilton solid screens appear to be in violation of county fence ordinance. They are <br /> extremely offensive to view from our $250,000 waterfront property. Hamilton has a long history <br /> of trespass and vandalism and trespass on the Chelmo property. <br /> b. Alternatives you considered that require a lesser variance and reasons you rejected them. If you reject such <br /> alternatives provide the reasons you rejected them. <br /> Reported these problems to Burnett County Land Services Department but have received no relief. <br /> We have no other authority to remove extremely offensive items on the property of others. <br /> We are tired of the trespass by Wallace guests. We are extremely tired of the trespass and <br /> vandalism by Hamilton and Hamilton extremely excessive complaints against Daniel Chelmo and <br /> the Chelmo farm.
