If a nonconforming structure <br /> 3 is not used for a period of 12 months, any future use of the structure shall conform to this chapter. <br /> 4 Nonconforming use means a lawful use that existed immediately prior to adoption of a zoning <br /> 5 ordinance which prohibits or restricts said use. If a nonconforming use is discontinued for a period of 12 <br /> 6 months, any future use shall conform to this chapter. <br /> 7 Nonfarm residence means a single-family or multi-family residence other than a farm residence. <br /> 8 Nonprofit conservation organization means any charitable corporation, charitable association or <br /> 9 charitable trust (such as a land trust), the purposes or powers of which include retaining or protecting the <br /> 10 natural scenic or open-space values of real property,assuring the availability of real property for agricultural, <br /> 11 forest, recreational or open-space use, protecting natural resources, maintaining or enhancing air or water <br /> 12 quality, or preserving the historical, architectural, archaeological or cultural aspects of real property. <br /> 13 Non-riparian lot means a lot or parcel of land which does not abut navigable water. <br /> 14 Non-riparian owner means someone who owns land which does not abut navigable water. <br /> 15 Overlay district means a zoning district that is superimposed on one or more other zoning districts and <br /> 16 imposes additional restrictions on the underlying districts. <br /> 17 Parcel. See "Lot". <br /> 18 Planned residential development means a housing development in a rural setting that is characterized <br /> 19 by compact lots and common open space, and where the natural features of the land are maintained to the <br /> 20 greatest extent possible. (Also known as a conservation subdivision). <br /> 21 Planned unit development means a zoning district which permits smaller non-riparian lots and <br /> 22 preserves open space preferably on the shoreland in perpetuity. <br /> 23 POWTS means a private onsite wastewater treatment system as defined in SPS 381 Wis. Admin. <br /> 24 Code. <br /> 25 Previously developed means a lot or parcel that was developed with a structure legally placed upon it. <br /> 26 Principal structure means a building or structure in which the principal use of the lot on which it is <br /> 27 located is conducted. <br /> 28 Quarry includes, but is not limited to; sand, gravel and marl pits. <br /> 29 Reconstruction means replacement of all, or substantially all (50 percent or more)of the components <br /> 30 of a structure or to the point when reconstruction of a principal structure will require the construction to be <br /> 31 done in accordance with the Uniform Dwelling Code, SPS 320-325 Wis. Admin. Code, or the Commercial <br /> 32 Building Code, SPS 361 Wis. Admin. Code. <br /> 33 Regional flood means a flood determined to be representative of large floods known to have occurred <br /> 34 in Wisconsin. A regional flood is a flood with a one percent chance of being equaled or exceeded in any <br /> 35 given year. <br /> 36 Renovation of a principle structure means the process of improving a structure by alteration, <br /> 37 refurbishment and/or restoration, including the replacement of less than 50 percent of the structural <br /> 38 members, but not to the point of requiring compliance as a new structure under the Uniform Dwelling Code, <br /> 39 SPS 320-325 Wis. Admin. Code, or the Commercial Building Code, SPS 361 Wis. Admin. Code. <br /> 40 Routine maintenance of vegetation means normally accepted horticultural practices that do not result <br /> 41 in the loss of any layer of existing vegetation and do not require earth disturbance. <br /> 42 Salvage yard means a lot, land or structure, or part thereof, used for the collecting, storage or sale of <br /> 43 waste paper, rags, scrap metal or discarded material;or for the collecting, dismantling, storage or salvaging <br /> 44 of machinery or vehicles not in running condition or for the sale of parts thereof. <br /> 45 Salvageable material means discarded material no longer of value as intended, but which is stored or <br /> 46 retained for salvage, sale or future reuse. <br /> Page 6 of 91 <br />
