I am writing to reach out for and request your assistance in meeting the following requirement: <br /> Section 59.692 of Wisconsin Statute outlines State of Wisconsin regulations for the zoning of shorelands on navigable <br /> waters. 2015 Wisconsin Act 55 amended s. 59.692(4)(b), Stats., by creating the following as additional language, <br /> "Notwithstanding s. 59.694(4),the department may not appeal a decision of the county to grant or deny a variance <br /> under this section but may, upon request of a county board of adjustment, issue an opinion on whether a variance <br /> should be granted or denied." (emphasis added). While this requirement was a change from previous practice it did not <br /> prohibit the department from submitting a comment letter to a county board of adjustment (BOA) for a shoreland <br /> zoning variance request,as long as it does not include an opinion on whether the requested variance should be granted <br /> or denied. This remains the current statutory language. <br /> Following the above amendment in 2015 the department received feedback from many county BOAs from across the <br /> state regarding their preference to receive department opinions on whether a given shoreland zoning variance request <br /> should be granted or denied. However, since this list has not been fully updated in over 5 or 6 years, BOA members may <br /> 1 <br />
