ORDER AND DETERMINATION <br /> THE REQUESTED VARIANCE IS GRANTED , HOWEVER, THE APPROVAL IS <br /> SUBJECT TO THE FOLLOWING CONDITIONS/EXCEPTIONS: <br /> With the following condition(s): <br /> 1- Shoreline restoration to current standards is required since the new dwelling is within the lake setback. <br /> 2- Sanitary system to be installed per current requirements for this new dwelling. <br /> 3- Sanitary system evaluation to be completed for the other dwellings/cabins on these six parcels by <br /> 6/1/2023. <br /> 4- Land use permit to be obtained for this new dwelling prior to construction. Which will include <br /> floodplain compliance. <br /> 5- Site address to be obtained for this new dwelling prior to land use permit issuance. <br /> 6- Certified Survey Map to be completed to reconfigure the six parcels into two parcels. <br /> 7- Remove boat landing. <br /> 8- Install small swale at bottom (lake side) of driveway pavement to slow down the water (and/or work with <br /> County Conservation Dept. on a similar solution). <br /> 9- Remove fish house concrete pad. <br /> 10- Concrete pad between the dwelling and the lake to be removed or replaced with a permeable surface. <br /> 11- Dwelling no more than 24 feet tall. <br /> 12- Follow all local, county, state and federal requirements for this activity. <br /> THE ZONING ADMINISTRATOR IS DIRECTED TO ISSUE A LAND USE PERMIT INCORPORATING THESE <br /> CONDITIONS. <br /> ANY PRIVILEGE GRANTED BY THIS DECISION MUST BE EXERCISED WITHIN ONE YEAR OF THE DATE OF <br /> THIS DECISION BY OBTAINING THE NECESSARY BUILDING, LAND USE AND OTHER PERMITS FOR THE <br /> PROPOSED CONSTRUCTION. THIS PERIOD WILL BE EXTENDED IF THIS DECISION IS STAYED BY THE <br /> ORDER OF ANY COURT OF OPERATION OF LAW. <br /> THIS DECISION MAY BE APPEALED BY FILING AN ACTION IN CERTIORARI IN THE CIRCUIT COURT FOR THIS <br /> COUNTY WITHIN 30 DAYS AFTER THE DATE OF FILING OF THE DECISION.
