Mulligan <br /> Attorney at Law <br /> PO Box 457 <br /> Spooner, WI 54801 <br /> RE: Garage Encroachment <br /> Dear Tom: <br /> I've reviewed your letter dated January 23, 2006, regarding the Birch Island Lake <br /> garage encroachment. I'm afraid that there's not much that either I or the Zoning <br /> Administrator can do with regard to this. We are certainly not in a position to allow a <br /> permit which would extend over onto someone else's land. Therefore, the only <br /> suggestions that I could give you would be for him to: 1) Either move the garage to the 5 <br /> foot setback; or 2) To see if he could get a variance if he did in fact cut off the 3-1/2 foot <br /> comer which would allow him to be within the 5 foot setback. As you are aware, <br /> however, neither myself, nor Mr. Flanigan has the authority to grant a variance,this can <br /> only be done by the Board of Adjustment. I would believe that he may want to see if he <br /> can get the variance before he goes ahead and cuts the garage off.
