r <br /> Article Two: Subdivision Permit,Survey And Recordine Requirements <br /> 2.1 Subdivision Permits <br /> (A) All parcels created with less than 40 acres will require a subdivision permit. <br /> (B) This permit will require review of deed descriptions by Land Information and zoning <br /> requirements by the Zoning Department for conformance with State Statutes,Administrative <br /> Codes and Burnett County Ordinances. <br /> 2.2 Subdivisions Not Reguirine Surveys <br /> (A) Parcels 10 acres or greater may be created as long as parcels have at least a nominal 300 feet of <br /> width,do not create conflict and meet zoning district lot standards. The following statement shall be <br /> included on the document or as an attachment to the document: <br /> "I certify that the legal description contained within this document represents a change of the <br /> legal description contained within document number recorded in <br /> Volume ,Page ,of the Office of the Register of Deeds and is creating, <br /> modifying,re-dividing,or redefining a parcel of land." <br /> (B) The sale or exchange of parcels between owners of adjoining property is permitted if additional lots <br /> are not thereby created and the resulting lots are not reduced below the minimum size required by <br /> Burnett County Land Use Ordinance or other applicable laws or ordinance. Documentation is <br /> necessary by either survey map or deed restriction stating the following: <br /> "The above described parcel is adjoining to and intended to be considered as a single parcel with <br /> the parcel described in Document Number Volume <br /> Page which is not to be conveyed or used as an independent parcel." <br /> 2.3 Subdivisions eguirine A Survey <br /> (A) All parcels created with less than 40 acres(except those created per 2.2(A and B)above)shall <br /> require a survey by a Wisconsin Registered Land Surveyor. <br /> (B) Prior to the final approval of land divisions requiring a survey,the owner of the land shall have <br /> the parcels surveyed by a Wisconsin Registered Land Surveyor. The surveyor shall create a <br /> certified survey map or plat,in the manner prescribed in Chapter 236,Wisconsin Statutes; unless <br /> exempt under the provisions of Article 6.3 of this Ordinance or unless waived in writing by the <br /> Land Use Committee. <br /> (C) Certified survey maps may be prepared and recorded for land divisions resulting in the creation of <br /> up to eight parcels within a period of five years except for those described in Section 2.2. <br /> (D) County,municipal or town plats may be prepared and recorded for all land divisions resulting in <br /> the creation of more than eight lots larger than 1%2 acres within a 5-year period of time not <br /> requiring a state approved recorded plat as provided in Chapter 236.13,Wisconsin Statutes. <br /> (E) Subdivisions created under Chapter 236.03,Wisconsin Statutes shall be subject to all applicable <br /> provisions of this Ordinance. <br /> 3 <br />
