3. Term. The lease shall commence on the Check-In Date and shall terminate on the Check-Out Date <br /> outlined in Section 1 (hereinafter the "Term" of the Agreement). Owner will provide Renter with the <br /> key lock box access code 2 days in advance of the Check-In Date to gain entry to the Property or have <br /> Linda and/or Gary personally greet the group at the home at the 4 pm checking, provided that full <br /> payments and deposits have been received <br /> 4. Reservation Requirements. Reservations are not considered"guaranteed"until a signed Agreement <br /> and full payment are received by Owner. Reservations booked will require Security Deposit, Cleaning <br /> fee, and rental payment in full on the date the reservation is made and Agreement is signed. <br /> 5. Security Deposit. A security deposit of full rental fee is required to reserve the Property and is due upon <br /> signing of this Agreement("Security Deposit"). The Security Deposit may be paid in credit drawn on a <br /> United States bank account. RENTER ACKNOWLEDGES AND UNDERSTANDS THAT THE <br /> SECURITY DEPOSIT: (I)IS REQUIRED TO SECURE THE RESERVATION; (II)WILL BE <br /> IMMEDIATELY PROCESSED BY THE VRBO CREDIT PROCESSING COMPANY AND <br /> APPLIED TOWARD THE TOTAL RENT DUE UNDER THIS AGREEMENT(AND SHALL <br /> OFFSET THE TOTAL RENT BY THE ENTIRE AMOUNT); AND (III)WILL NOT BE REFUNDED <br /> TO RENTER UNDER ANY CIRCUMSTANCES UNLESS RENTAL IS CANCELED MORE THAN <br /> 60 DAYS FROM CHECK IN DATE. Renter acknowledges and agrees that, as a result of the reservation <br /> of the Property anticipated herein, Owner will be unable to rent the Property to other potential renters. <br /> Renter further acknowledges and understands that the Security Deposit will be forfeit if Renter has a <br /> cancellation within the 60 days to check in date. Total Rent, Damage and rules Deposit within the time <br /> periods prescribed herein, that failure to make such payments and deposits shall result in termination of <br /> this Agreement, and that Owner shall have no duty to mitigate following such termination. Owner shall <br /> provide a written receipt via U.S. Mail, facsimile, VRBO email, Text message or personal email <br /> response upon receipt of the Security, Damage and Violation of Home Rental Rules Deposit. <br /> 6. Damage and Violation of Home Rental Rules Deposit.A deposit of$500 must be paid by Renter to <br /> Owner at time of rental agreement and with initial Security Deposit. The Damage and Violation of <br /> Home Rules Deposit shall be cashed and held by the VRBO Processing Center, and Renter hereby <br /> authorizes Owner to deduct from the Damage and Violation of Home Rules Deposit, or charge the <br /> Renter directly, at Owner's option, for any damage, disregard or excessive use that may or may not <br /> result in additional fees, cleaning and or repair to the home. Disregard to Home Rules of the Property <br /> arising from Renter's rental or Violation of Home Rules can result in forfeiting entire deposit. Renter <br /> will not be charged for normal wear and tear to the Property.The Damage and Rules Deposit will be <br /> refunded to renter within fourteen(14)days of the Check-Out Date; or if any amount or the whole of the <br /> Damage and Rules Violation Deposit is to be withheld for failure to follow proper rules, check-out <br /> procedures or for damages to the Property, Owner will provide to Renter a written statement itemizing <br /> such deductions from the Damage and Violation of Home Rules Deposit with the 14-day period. No <br /> interest will be paid on Damage and Violation of Home Rues Deposit monies held by Credit Card <br /> Process Center. Owner shall provide a written receipt via U.S. mail, facsimile,VRBO email, Text <br /> Message or personal email upon receipt of the Damage and Violation of Home Rules Deposit. <br /> 7. Confirmation of Reservation Confirmation of the reservation will be emailed,text, faxed, or mailed to <br /> Renter upon receipt of the signed Agreement, and payment of the Security,Damage and Violation of <br /> Home Rules Deposit Deposit. Renter agrees to read the confirmation for accuracy of dates, mailing <br /> address, number of occupants and accommodations. Renter shall inform Owner of any errors <br /> immediately after receipt of confirmation. <br />
