Bernard C. Seidling appeared by telephone in court. Prosecuting Attorney <br /> David I Grindell in court for Plaintiff County of Burnett in person. Court notes two letters were filed with the <br /> court but not a true agreement, needs to understand their agreement. Attny Grindell spoke with Mr. Seidling. <br /> Attny Grindell confirmed,filed amended citations with both Trust names. Exhibit 1 and 2 filed by Attny <br /> Grindell,Trust Deeds. Webster Land Trust deeded the land to Indies FLP Trust on 10-28-2021; and then on <br /> 1-27-22 deeded land to Welch Road Land Trust. Trustee was Bernard Seidling for both. Court notes in <br /> Burnett County case 16CV183 an Order from Judge Thimm that Bernard Seidling is prohibited from <br /> transferring any interest in real property by assignment through a trust or otherwise without first recording an <br /> assignment of land contract. So all of Bernard Seidlings transactions need a land contract. Judge wants to see <br /> land contract.Attny Grindell notes no land contract. Bernard Seidling confirms no land contract, not an arms <br /> length sale. Court has read Eau Claire County Order, Judge Thimms Order, and Burnett Co case 08SC152. <br /> If no land contract Bernard Seidling is in violation of these orders. Court makes a statement that Bernard <br /> Seidling is trying to evade a number of requirements. Court notes this Welch land transfer was after these <br /> citations were issued. Attny Grindell notes he has filed a Lis Pendens, and replies that is why we needed to <br /> file amended citation. Attny Grindell notes looking for a Judgment of Conviction on zoning citations for 6 <br /> violations,junkyard issue, if agreement not followed within time frame then will come back and request court <br /> costs.Attny Grindell notes the Sheriffs Department did go out to land, and resident here as a witness. Sale of <br /> land was before Judge Thimms order. Bernard Seidling agrees that agreement with Attny Grindell is correct, <br /> wishes to remove trespasser and clean up junk yard. Attny Grindell has a contract with Kelly J. <br /> Lowell and Webster Land Trust, Bernard Seidling confirms in 2011. In 2011, Webster Land Trust owned this <br /> land in question, on 10-18-2021 transferred it to Indies FLP Trust Doc#47262, property 20.86 acres <br /> described was transferred. Bernard Seidling confirms. Court notes these 6 citations then issued on 11-19- <br /> 2021, Bernard Seidling notes that isn't when he received them. Court notes change of address etc. in file. <br /> Bernard Seidling received the citations in Jan or Feb 2022. Court notes that Indies FLP Trust transferred all of <br /> its interests and property, on 1-27-2022, to Welch Road Land Trust transferring the 20.86 acres.This was <br /> during the time this citation has been ongoing. Court and def confirm. Court now knows transfer of property <br /> and timeline. Welch Road Land Trust is now who has any and all interest on this property, court trying to <br /> figure out who will be responsible for cleaning up these zoning violations. Bernard Seidling is a trustee for <br /> Welch Road Land Trust, so Court would see him as being here on the phone and trustee that would be <br /> responsible. Court notes doesn't have a trust document to know who is legally responsible. Bernard Seidling <br /> notes he is one of the trustees for Welch Road Land Trust. Court reiterates, doesn't have trust agreement. <br /> Bernard Seidling confirms Roger Halstead is a trustee also. Court makes a statement. Bernard Seidling <br /> makes a statement.
