Your Land Use Permit for the addition of the basement does not include grading. No grading <br /> or filling is permitted within the 35 foot Shoreland Buffer Zone;and a Land Use Permit is required for <br /> grading and filling more than 1000 square feet on slopes of 12 to 20%,within 300 feet of the Ordinary <br /> High Water Mark of a navigable water body. Your project falls into this category. <br /> Enclosed you will find a Land Use Permit application for the grading and filling already done. In as much <br /> as we did not specifically discuss the disposition of the excavated material as part of your permit <br /> application,I am not assessing a double fee for an"after the fact"permit. You will need to install <br /> appropriate erosion control measures,such as a silt fence along the lower edge of the graded area,and seed <br /> and mulch to stabilize the graded area,as soon as possible. You also will need to remove any fill that is <br /> within the 35 foot Shoreland Buffer Zone. The grading and filling as it is today,constitutes a violation of <br /> Section 4.4,Shoreland Regulations,(4).
