ORDER AND DETERMINATION <br /> THE REQUESTED VARIANCE IS GRANTED, HOWEVER, THE APPROVAL IS SUBJECT <br /> TO THE FOLLOWING CONDITIONS/EXCEPTIONS: <br /> With the following condition(s): <br /> 1- Land Use permit to be obtained for the patio/fire pit/walkway/retaining wall by 6/1/2024. <br /> 2- Follow all local, county, state and federal requirements for this activity. <br /> 3- Shoreline restoration should be made part of the approval since the patio/fire pit/walkway/retaining wall <br /> is within the lake setback. The current standard allows a viewing/access corridor of 35 feet per 100 feet <br /> of shoreline (up to a maximum of 200 ft of viewing/access corridor). They have approximately 100 ft of <br /> shoreline, so they would be allowed 35 ft of viewing/access corridor. [Currently they have about 100 ft <br /> of viewing/access corridor]. <br /> 4- Impervious area likely exceeds 15% since the surveyor did not include the driveway in the calculations. <br /> If over 15%then mitigation will be required. <br /> THE ZONING ADMINISTRATOR IS DIRECTED TO ISSUE A LAND USE PERMIT INCORPORATING THESE <br /> CONDITIONS. <br /> ANY PRIVILEGE GRANTED BY THIS DECISION MUST BE EXERCISED WITHIN ONE YEAR OF THE DATE OF <br /> THIS DECISION BY OBTAINING THE NECESSARY BUILDING, LAND USE AND OTHER PERMITS FOR THE <br /> PROPOSED CONSTRUCTION.
