Much of the discussion
is missing concrete information about the actual boundaries of the wet land area, whether this
area is lake bottom, and location of the high-water mark. All of these need accurate verifiable
data. The issues were also complicated by the flooding of the lake over the last 3 years. The
result is I have limited access to the lake from my property and inability to launch my dock and
pull it out prior to winter.
Now that the lake flooding has subsided, I want to fill a path to the lake of aboutl0 - 20 foot
wide which does conform to the discussions I have had with Dan Harrington. I by no means
intend to eliminate the wet land nor to reduce the size of the wet land. Let's look at the
situation.
1. I have 110 feet of lake shore. A large portion of the 110 feet has morphed into wet
land. This was not the case for many years.
2. I have attached pictures of the property for most of the time I have owned the property
prior to the lake flooding of recent years (see attached .pdf entitled Pictures Pre Flood).
3. I have corresponded with Dan Harrington many times as to the option to provide access
to the lake.
4. I did contact Bill Sande Corps of Engineers to provide me and idea of the parameters of
the wet land and he did flag the wet land area since local DNR never has been to my
property. (See pictures img_1227 and img_1228 of the flags). These pictures were sent
to Dan Harrington by Bill Sande.
5. Dan did reply to my request for options. ( See attached email entitled Email from Dan
Harrington regarding Corp of Engineering Flags which he stated "Although I have not
been to your site, I have reviewed photos that Mr. Sande has provided me. Specifically
the photo with two pink flags. This is the area where you could fill up to, with no DNR
or COE permits." He further stated "Filling waterward of those flags will require a permit
and a wetland delineation?".
6. The landward property is from the flags to the road (south) and to the right (east) of the
flags to our property line. We have no landward on the west of the property since the wet
land goes to our west property lot line. We, therefore, are planning to run a path on the
2
