• <br /> ORDER AND DETERMINATION <br /> THE REQUESTED VARIANCE IS GRANTED, HOWEVER, THE APPROVAL IS SUBJECT <br /> TO THE FOLLOWING CONDITIONS/EXCEPTIONS: <br /> With the following condition(s): <br /> 1- Shoreline restoration should be made part of the approval since the proposed expansion is within the <br /> lake setback. The current standard allows a viewing/access corridor of 35% of the shoreline (up to a <br /> maximum of 200 ft of viewing/access corridor). They have approximately 150 feet of shoreline, so they <br /> would be allowed 52.5 feet of viewing/access corridor. <br /> 2- Land Use permit to be obtained for the addition prior to construction. <br /> 3- Proper erosion control and storm water runoff controls to be in place. <br /> 4- Follow all local, county, state and federal requirements for this activity. <br /> 5- Additions not to exceed the height of the current structure. <br /> THE ZONING ADMINISTRATOR IS DIRECTED TO ISSUE A LAND USE PERMIT INCORPORATING THESE <br /> CONDITIONS. <br /> ANY PRIVILEGE GRANTED BY THIS DECISION MUST BE EXERCISED WITHIN ONE YEAR OF THE DATE OF <br /> THIS DECISION BY OBTAINING THE NECESSARY BUILDING, LAND USE AND OTHER PERMITS FOR THE <br /> PROPOSED CONSTRUCTION. THIS PERIOD WILL BE EXTENDED IF THIS DECISION IS STAYED BY THE <br /> ORDER OF ANY COURT OF OPERATION OF LAW. <br /> THIS DECISION MAY BE APPEALED BY FILING AN ACTION IN CERTIORARI IN THE CIRCUIT COURT FOR THIS <br /> COUNTY WITHIN 30 DAYS AFTER THE DATE OF FILING OF THE DECISION.
