Affidavit <br /> On May 26,2010,I, Paul F.Villetla, attended Burnett County Court for the hearing of BURNETT <br /> COUNTY v Edward J. Cycenas,case number 09-FO-423.I observed and heard the following;The <br /> judge hearing the case was Judge Kenneth Kutz,the prosecuting attorney was David Grindell and the <br /> two witnesses were James Flanigan,and Carl Lippert.David Grindell,James Flanigan,Carl Lippert, <br /> and BURNETT COUNTY are defendants' in the Federal Complaint, 10-C-253-BBC.As the hearing <br /> began,Edward Joseph Cycenas'informed the court that there is a Federal Claim filed and Judge <br /> Kenneth Kutz acknowledged that he knew and read part of the complaint.At that time Edward J. <br /> cycenas told the judge that he forgot to give the court the ORDER by Judge Crabb,and asked to give it <br /> to the court at that time. Judge Kutz said yes and David Grindell stated that it was the standard form for <br /> summons to Federal Court and they(defendants'?) have them. <br /> Judge Kutz stated that they were going to continue with the hearing. <br /> Judge Kutz stated that he had signed the search warrant.Nothing was brought up about the search <br /> warrant prior to Judge Kutz's remark or after. <br /> Tresevant was brought up and Edward Cycenas stated that Tresevant dealt with the Mississippi <br /> river and the high water marks for levy's for navigable waterways. Judge Kutz said that Tresevant <br /> dealt with the State taking the private property rights and that the State had those rights so they could <br /> regulate private property.Judge Kutz would not allow Edward J.Cycenas to bring up Navigable <br /> Waterways.All of which are in the Federal Complaint. <br /> No denials of admissions or of owing money to Edward J.Cycenas were admitted by BURNETT <br /> COUNTY, Grindell,Flanigan,or Lippert in the Hearing. <br />
