Box 614 <br /> Webster, WI 54893 BurnettGounty *CERTIFIED MAIL* <br /> Land Services Department <br /> Subject: Notice of Noncompliance with NR 216.43-44 Wisconsin Storm Water Rules <br /> ,c8 3.s-- <br /> March 5, 2024 <br /> Dear Mr Erickson; <br /> This notice advises you that the Department of Natural <br /> Resources(DNR) has reason to believe that you are in <br /> noncompliance with Wisconsin Administrative Code NR <br /> 216.46 and 216.47, Construction Site Storm Water <br /> Discharge Permits for failure to apply for and obtain <br /> storm water permit coverage for land disturbance in • <br /> the Town of Jackson in Burnett County for grading one <br /> or more acres of land. The land is located at 5051 <br /> County Rd A,or pt. NW/NE sec 29,T4ON R15W. <br /> Since 2003, Federal and state laws require landowners _ a <br /> to obtain permit coverage where land disturbance is `" <br /> greater than or equal to one acre. Municipalities and <br /> landowners who disturb more than an acre in <br /> Wisconsin need to obtain permit coverage from DNR. <br /> You can read more about Wisconsin's Storm Water Program at <br /> https://dnr.wisconsin.gov/topic/Stormwater. <br /> According to land records you acquired the property in 2021. Aerial photography from 2020 shows a <br /> vegetated area. Sometime between 2020 and 2023 the site (approximately 3 acres) was graded, <br /> vegetation removed and a storage building was constructed without storm water permit coverage. You <br /> applied for and received a Conditional Use Permit from Burnett County Land Services on October 28, <br /> 2021 for a "mini storage rental building or storage rental building." <br /> Please submit a completed after-the-fact application for construction site permit coverage to the Dept. <br /> no later than May 31, 2024 in order to avoid further enforcement action. I will be requesting a citation <br /> be issued to you for failure to apply for coverage under a construction site storm water discharge permit <br /> at least 14 working days before beginning land disturbing construction per NR 216.43 and 216.44. <br /> dnr.wi.gov �SN�w <br /> wisconsin.gov Naturally WISCONSIN <br />
