It is my opinion that that existing center line <br /> is the best remaining evidence of the intent of the highway <br /> conveyances. The description in Deed Volume 1009 Page 436 does <br /> not fit the highway based on the existing monumented section <br /> line. <br /> 2) From Point /1 a six foot steel fence post bears S88'19'W 1 .56 <br /> feet . This post was set replacing a 1-1/4 inch iron pipe found <br /> and its origin is CSM Volume 7, Page 227. A second six foot <br /> steel fence post bears S87'23 '37"E 16.02 feet from Point 111 . <br /> This post was set replacing a bent steel post found whose origin <br /> is CSM Volume 1, Page 70. <br /> 3) This parcel is deeded in Volume 442 of Deeds, Page 640. The <br /> north line of this parcel was first surveyed by Raymond Buggert <br /> in 1962. A copy of that survey is recorded as Certified Survey <br /> Map Volume 1 , Page 70. In 1981 the land north of this line was <br /> surveyed. That survey is recorded as Certified Survey Map Volume <br /> 7 , Page 227 . It appears that CSM Volume 79 Page 227 was an <br /> attempt to match Raymond Buggert ' s work. Although the deed call <br /> differs slightly from the surveyed line, I have accepted Raymond <br /> Buggert ' s placement of the line for the purposes of this survey. <br /> 4) Old State Highway ' 35 ' and Waldora Road right-of-way widths <br /> are shown as 66 feet wide. The original intended width of these <br /> roads is unknown. <br /> 5) I was not commissioned to located improvements , above ground <br /> utilities, below ground utilities, tanks, wells or other <br /> structures on the property surveyed. I accept no responsibility <br /> for the occurrence, condition or placement of these things. <br /> 6) Burnett County Subdivision Control Ordinance 1 .5 Definitions <br /> (F) jot , contains the explanation that "Adjoining lands of common <br /> ownership shall be considered a contiguous parcel even if divided <br /> by a public or private road, easement or navigable rivers or <br /> streams, . . . .
