ORDER AND DETERMINATION <br /> THE REQUESTED VARIANCE IS GRANTED, HOWEVER, THE APPROVAL IS SUBJECT <br /> TO THE FOLLOWING CONDITIONS/EXCEPTIONS: <br /> With the following condition(s): <br /> 1- Shoreline to follow state standard viewing and access corridor width, which is not to exceed 30%of the <br /> shoreline for the corridor width, and the vegetated natural area needs to be a depth of 37.5 landward <br /> from the Ordinary High Water Mark (OHWM). This is the same requirement as listed in state statute <br /> 59.692(1v)(d) which allows up to 200 sq ft of open sided construction within the 75 ft setback. (They <br /> already have 200 sq ft of building within the setback—therefor the need for a variance). <br /> 2- Lock and chain to be installed on the septic tank by 8/1/2024. <br /> 3- Land Use permit for the deck to be obtained prior to construction. <br /> 4- Follow all local, county, state and federal requirements for this activity. <br /> THE ZONING ADMINISTRATOR IS DIRECTED TO ISSUE A LAND USE PERMIT INCORPORATING THESE <br /> CONDITIONS. <br /> ANY PRIVILEGE GRANTED BY THIS DECISION MUST BE EXERCISED WITHIN ONE YEAR OF THE DATE OF <br /> THIS DECISION BY OBTAINING THE NECESSARY BUILDING, LAND USE AND OTHER PERMITS FOR THE <br /> PROPOSED CONSTRUCTION. THIS PERIOD WILL BE EXTENDED IF THIS DECISION IS STAYED BY THE <br /> ORDER OF ANY COURT OF OPERATION OF LAW. <br /> THIS DECISION MAY BE APPEALED BY FILING AN ACTION IN CERTIORARI IN THE CIRCUIT COURT FOR THIS <br /> COUNTY WITHIN 30 DAYS AFTER THE DATE OF FILING OF THE DECISION.
