ORDER AND DETERMINATION <br /> THE REQUESTED VARIANCE IS GRANTED, HOWEVER, THE APPROVAL IS SUBJECT <br /> TO THE FOLLOWING CONDITIONS/EXCEPTIONS: <br /> With the following condition(s): <br /> 1- Shoreline to follow state standard viewing and access corridor width, which is not to exceed 30% of the <br /> shoreline for the corridor width, and the vegetated natural area needs to be a depth of 37.5 feet <br /> landward from the Ordinary High Water Mark (OHWM). This is the same requirement as listed in state <br /> statute 59.692(1v)(d) which allows up to 200 sq ft of open sided construction within the 75 ft setback. <br /> (Almost the entire project is within the 75 ft setback — as the lake on the west side is very close as well) <br /> (They have approximately 500 ft of shoreline which would allow a 150 ft wide viewing and access <br /> corridor). <br /> 2- Gutters and downspouts added to the cabin with the water directed to a rain garden(s). (This is <br /> additional mitigation for exceeding the 200 sq ft within the 75 ft setback). <br /> 3- Land Use permit to be obtained prior to the structure being constructed. <br /> 4- Need lock/chain on septic tank by 10/1/2024. <br /> 5- Proper erosion control and storm water runoff controls to be in place. <br /> 6- Follow all local, county, state and federal requirements for this activity. <br /> THE ZONING ADMINISTRATOR IS DIRECTED TO ISSUE A LAND USE PERMIT INCORPORATING THESE <br /> CONDITIONS. <br /> ANY PRIVILEGE GRANTED BY THIS DECISION MUST BE EXERCISED WITHIN ONE YEAR OF THE DATE OF <br /> THIS DECISION BY OBTAINING THE NECESSARY BUILDING, LAND USE AND OTHER PERMITS FOR THE <br /> PROPOSED CONSTRUCTION. THIS PERIOD WILL BE EXTENDED IF THIS DECISION IS STAYED BY THE <br /> ORDER OF ANY COURT OF OPERATION OF LAW. <br /> THIS DECISION MAY BE APPEALED BY FILING AN ACTION IN CERTIORARI IN THE CIRCUIT COURT FOR THIS <br /> COUNTY WITHIN 30 DAYS AFTER THE DATE OF FILING OF THE DECISION.
