BURNETT COUNTY LAND SERVICES DEPARTMENT c <br /> BURNETT COUNTY GOVERNMENT CENTER <br /> 7410 County Road K,#120 Phone(715)349-2109 <br /> Siren,Wisconsin 54872 landservices@burnettcounty.org <br /> NOTICE OF ACTION ON CONDITIONAL USE PERMIT <br /> August 8, 2024 <br /> Mathy Construction Co <br /> Attn: Jeff Johnson <br /> PO Box 1246 <br /> Eau Claire, WI 54701 <br /> RE: CONDITIONAL USE PERMIT#CUP-24-16 <br /> Dear Property Owner, <br /> At the July 2nd, 2024 meeting of the Land Use and Information Committee, your <br /> application for a Conditional Use Permit application was considered. <br /> On the basis of the evidence presented at the hearing on this application, it was <br /> determined that a Conditional Use Permit be GRANTED subject to the following <br /> conditions: <br /> 1- Existing vegetation within the 50 foot buffer be maintained,replenished,undisturbed as tie <br /> o <br /> needed to act as screening for the project. N <br /> 2- Existing vegetation within the 75 foot buffer along the northerly property line to be <br /> maintained,replenished,undisturbed as needed to act as screening for the project. <br /> 3- Mineral rights issue to be resolved before any materials are removed/processed on the <br /> expansion area. E <br /> 4- Follow all local, county, state and federal requirements for this activity. iw <br /> 5- Utilize existing driveway/entrance. No new entrance/exit. <br /> 6- Provide the Town/County copies of applicable plans/permits, specifically: storm water <br /> and spill prevention/pollution control,erosion control,and air quality control. <br /> 7- Minimum 75 foot setback from all wetlands and the northerly property lines. R° <br /> 8- Minimum 50 foot setback from all other property lines and roads. <br /> 9- Hours of operation: 6:00 am—8:00 pm,Mon-Fri; 6:00 am—4:00 pm, Saturday. <br /> Maintenance may be done after these hours. <br /> 10- Final expansion of mining operations on these parcels. <br /> 11- Mining area to be reclaimed to passive recreation IAW Reclamation Plan as soon as sand <br /> and gravel reserves are depleted and formerly excavated areas with stockpiles are no <br /> longer needed. <br /> 12- Reclamation Plan will include planting of native pine species(red,white and jack)over a <br /> minimum of 20 percent of the parcels and removal of all asphalt pieces and millings. <br /> 13- Review CUP progress and any concerns with the Town Board every 5 years. <br /> 14- Any continuous operation of temporary asphalt plant beyond 12 weeks shall require <br /> Town Board approval. <br /> 15- Old CUP to be terminated and all three parcels to be included in the new CUP. <br /> 16- CUP expires upon sale or transfer of the parcel(s). <br />
