ORDER AND DETERMINATION <br /> THE REQUESTED VARIANCE IS GRANTED, HOWEVER, THE APPROVAL IS SUBJECT <br /> TO THE FOLLOWING CONDITIONS/EXCEPTIONS: <br /> With the following condition(s): <br /> 1- Shoreline restoration required, they have approximately 100 ft of shoreline, so they would be allowed 30 <br /> ft of viewing/access corridor. The buffer depth shall be at least 37.5 ft from the Ordinary High Water <br /> Mark (OHWM). <br /> 2- Land Use permit to be obtained by 11/1/2024. <br /> 3- Can keep 25 ft with boulders (north side to remain). Rest of them to be removed and the area restored. <br /> 4- Proper erosion control and storm water runoff controls to be in place, with rain gutters and rain garden <br /> per Land Conservation recommendation. <br /> 5- Follow all local, county, state and federal requirements for this activity. <br /> THE ZONING ADMINISTRATOR IS DIRECTED TO ISSUE A LAND USE PERMIT INCORPORATING THESE <br /> CONDITIONS. <br /> ANY PRIVILEGE GRANTED BY THIS DECISION MUST BE EXERCISED WITHIN ONE YEAR OF THE DATE OF <br /> THIS DECISION BY OBTAINING THE NECESSARY BUILDING, LAND USE AND OTHER PERMITS FOR THE <br /> PROPOSED CONSTRUCTION. THIS PERIOD WILL BE EXTENDED IF THIS DECISION IS STAYED BY THE <br /> ORDER OF ANY COURT OF OPERATION OF LAW. <br /> THIS DECISION MAY BE APPEALED BY FILING AN ACTION IN CERTIORARI IN THE CIRCUIT COURT FOR THIS <br /> COUNTY WITHIN 30 DAYS AFTER THE DATE OF FILING OF THE DECISION.
