Case 2023CV000086 Document 64 Scanned 10-04-2024 Page 4 of 26
court should enter judgment in favor of the moving party. Id. at
356 . A motion for judgment on the pleadings shall be treated as a
motion for summary judgment where the trial court considers matters
outside of the pleadings. Carlson v. Pepin County, 167 Wis . 2d
345 , 481 N.W. 2d 498 (Ct . App. 1992) .
II . WIS . STAT. § 66 . 1014, LIMITS ON RESIDENTIAL DWELLING
RENTAL PROHIBITED, I.E. , WISCONSIN' S RIGHT TO RENT LAW
Wis . Stat . § 66 . 1014 , Limits on residential dwelling rental
prohibited, also known as Wisconsin' s right to rent law, balances
the rights of property owners to rent their homes and the rights
cf their neighbors to use and enjoy their property. The law was
passed in response to a growing number of local governments banning
the rental of residential dwellings for any period of time less
than 30 days and prohibits those types of blanket bans . Wisconsin' s
right to rent law encourages fair regulation by local governments
to regulate short-term rental activity in a fair and reasonable
manner.
There are significant points regarding the law to pay
particular attention to, because there are some restrictions . The
first, local governments can regulate, but not prohibit, short-
term rentals seven days or longer.
Second, local governments can require owners to obtain local
permits or licenses to rent their property for short-term rentals .
Third, local governments are allowed to place a six-month or
180-day cap on the amount of time property owners can rent out
their home during any 365-day period. Moreover, the law allows,
but does not require, local governments to mandate the 180 days to
be continuous . In communities that have adopted a six-month cap,
property owners are allowed to choose which six-month period the
dwelling is rented.
4
