AL c <br /> f <br /> pe <br /> Burnett County <br /> *- Don Taylor <br /> Board of Supervisors County Board Chair <br /> / County Government Center,Room 161 <br /> 7410 County Road K, #111 Phone: 715-349-2181 ext 1334 <br /> Siren, WI 54872 Fax: 715-349-2180 <br /> December 20, 2024 <br /> RE: Bocan Conditional Use Permit Decision <br /> On January 11,2021,the Land Use and Information Committee of the Burnett County Board of <br /> Supervisors voted to reject the application made by the Bocan family for a conditional use permit <br /> for a campground. The Bocans subsequently appealed that decision,bringing legal action in both <br /> circuit and federal court. <br /> As the litigation progressed,negotiations occurred between the Bocan family and County Board. <br /> Ultimately an agreement was reached between the Bocans and the County Board that in <br /> exchange for the County agreeing to not appeal a decision by Judge Tolan in the circuit court <br /> case,should the ruling be unfavorable to the County, the Bocans agreed to dismiss the federal <br /> action. This agreement was reached after careful consideration and significant consultation with <br /> the County's attorneys regarding the particular facts and circumstances of the case. Additionally, <br /> the risks of an ongoing federal action were carefully considered, and the County Board of <br /> Supervisors decided it was in the best interest of the County to negotiate a resolution that <br /> eliminated any potential federal liability and associated monetary judgements against the County. <br /> On November 22, 2024,Judge Tolan ruled in favor of the Bocans, and ordered the Conditional <br /> Use Permit to be issued.
