Page 2
transfer title, we have indicated to Land &Cabin willingness to document a shared use so they
might maintain title and Hines would accept an easement for use that would not materially
interfere with the use by a titled owner. Land &Cabin has simply responded that such use is
trespass. We, of course, disagree.
We have not addressed the obvious issues caused by this huge marshy area and where there
might be any buildable area. It should be noted that this marsh does flood, further expanding the
wetland area. We trust the County will require compliance on those fronts.
It is our hope that the County require Land &Cabin to resolve the access and use concerns of the
Ham Lake lot owners as part of its subdivision process. It makes no sense to not document now
and create future issues for neighbors who have used this necessary access to Mail Road for over
70 years.
I would welcome a conversation about your thoughts about this proposed development. We
would ask that we receive notice of any consideration of the Land &Cabin development by the
county or township. Should you have any questions, please do not hesitate to contact me.
Sincerely,
--lo;7 ew
Jeffrey A. Redmon
Cc: Joan B Hines Trust
