CONCLUSIONS OF LAW <br /> THE VARIANCE MUST MEET ALL THREE OF THE FOLLOWING TESTS: <br /> A. UNNECESSARY HARDSHIP IS PRESENT IN THAT A LITERAL ENFORCEMENT OF THE TERMS OF THE <br /> ZONING ORDINANCE WOULD DENY THE APPLICANT ALL REASONABLE USE OF THE PROPERTY <br /> BECAUSE: <br /> APPLICANT'S LOT WAS CREATED PRIOR TO ANY ORDINANCES <br /> B. THE HARDSHIP IS DUE TO PHYSICAL LIMITATIONS OF THE PROPERTY RATHER THAN THE <br /> CIRCUMSTANCES OF THE APPELLANT BECAUSE: <br /> APPLICANT HAS NO BUILDING AREA WHICH WOULD MEET REQUIRED SETBACKS <br /> C. THE VARIANCE WILL NOT BE CONTRARY TO THE PUBLIC INTEREST AS EXPRESSED BY THE <br /> OBJECTIVES OF THE ORDINANCE BECAUSE: <br /> APPLICANT'S ADDITION WILL MEET ORDINANCE OBJECTIVES FOR STRUCTURES <br /> BETWEEN 40 AND 75 FEET FROM THE ORDINARY HIGH WATER MARK OF LAKE <br />
