Any person who violates this ordinance may be subject to forfeitures as established by the Burnett County <br /> Citation Ordinance. Each day of violation shall constitute a separate offense. <br /> MON 116-0 NONCONFORMING USES AND STRIM URFS <br /> F10.1 Nonconforming Uses and Structures <br /> The existing lawful use of a structure or premises which is not in conformance with the provisions of this <br /> ordinance may be continued subject to the following conditions: <br /> (1) No structural addition to any nonconforming structure over the life of the structure shall exceed fifty <br /> percent (50%) of its current fair market value, unless the structure is permanently changed to a conforming <br /> use, the property rezoned to an appropriate zoning district, or a variance permitting expansion beyond 50% <br /> of fair market value is successfully obtained. <br /> The amount of increase value will be determined by total cost of alteration and/or addition. Estimates of <br /> project cost must be provided using going labor rates and material costs. <br /> (2) If such use is discontinued for twelve (12) consecutive months, any future use of the building and premises <br /> shall conform to this ordinance. <br /> (3) Uses or adjuncts thereof which are nuisances shall not be permitted to continue as nonconforming uses. <br /> SECTTON 11.0 BOARD t7F ADTTISIMENT <br /> A Board of Adjustment is hereby created and appointed in accordance with the provisions of Section 59.694 <br /> Wisconsin Statutes. The Board of Adjustment shall have the duties and powers provided by 59.694 Wisconsin <br /> Statutes and Rules and By-Laws of the Burnett County Board of Adjustment as adopted by the Burnett County Board <br /> of Supervisors. <br /> 11.1 POWERS OF THE BOARD <br /> The Board of Adjustment shall have all of the following powers: <br /> (1) To hear and decide appeals where it is alleged there is error in an order, requirement, decision or <br /> determination made by an administrative official in the enforcement of s. 59.69 or of any ordinance <br /> enacted pursuant thereto. <br /> (2) To hear and decide special exceptions to the terms of the ordinance upon which the board is required to <br /> pass under such ordinance. <br /> (3) To authorize upon appeal in specific cases variance from the terms of the ordinance that will not be <br /> contrary to the public interest, where, owing to special conditions, a literal enforcement of the provisions <br /> of the ordinance will result in unnecessary hardship, and so that the spirit of the ordinance shall be <br /> observed and substantial justice done. <br /> 63 <br />
