ORDER AND DETERMINATION <br /> THE REQUESTED VARIANCE IS GRANTED, HOWEVER, THE APPROVAL IS SUBJECT <br /> TO THE FOLLOWING CONDITIONS/EXCEPTIONS: <br /> With the following condition(s): <br /> 1- Shoreline to be restored to the following standard -viewing and access corridor not to exceed 50% of <br /> the shoreline for the corridor width, and the vegetated natural area needs to be to a depth of 37.5 feet <br /> landward from the Ordinary High Water Mark (OHWM). (They have approximately 100 ft of shoreline <br /> which would allow a 50 ft wide viewing and access corridor) <br /> 2- Gutters and downspouts on either the new house or the existing garage and the water directed to a <br /> rain garden. <br /> 3- Follow all floodplain requirements. <br /> 4- Lock and chain to be installed on septic tank by 11/15/2025. <br /> 5- Unknown pvc pipe to be removed by 8/1/2026. <br /> 6- Land Use permit to be obtained prior to construction. <br /> 7- Septic system to be sized for the number of bedrooms including the existing bunkhouse. <br /> 8- Proper erosion control and storm water runoff controls to be in place. <br /> 9- Follow all local, county, state and federal requirements for this activity. <br /> THE ZONING ADMINISTRATOR IS DIRECTED TO ISSUE A LAND USE PERMIT INCORPORATING THESE <br /> CONDITIONS. <br /> ANY PRIVILEGE GRANTED BY THIS DECISION MUST BE EXERCISED WITHIN ONE YEAR OF THE DATE OF <br /> THIS DECISION BY OBTAINING THE NECESSARY BUILDING, LAND USE AND OTHER PERMITS FOR THE <br /> PROPOSED CONSTRUCTION. THIS PERIOD WILL BE EXTENDED IF THIS DECISION IS STAYED BY THE ORDER <br /> OF ANY COURT OF OPERATION OF LAW. <br /> THIS DECISION MAY BE APPEALED BY FILING AN ACTION IN CERTIORARI IN THE CIRCUIT COURT FOR THIS <br /> COUNTY WITHIN 30 DAYS AFTER THE DATE OF FILING OF THE DECISION.
