Benoit Lake Road <br /> Spooner,WI5480I <br /> RE: Land Use Application for Dwelling at 26985 E. Benoit Lake Road. <br /> Dear Richard, <br /> I have reviewed and approved your Land Use Application for a dwelling at 26985 E. <br /> Benoit Lake Road. This office established the 75-foot setback from Benoit Lake at our <br /> on-site last month. The proposed house is approximately 89 feet from the OHWM, with <br /> plans for a future deck and porch extending 14 feet from the house,to the 75-foot setback <br /> line. <br /> This site is at the crown of a very steep slope to the lake, and you are proposing a design <br /> with a walkout basement. Benoit Lake is a Class 2 lake;with the near shore no <br /> disturbance area extending to 50 feet back from the Ordinary High Water Mark. <br /> The following conditions are hereby added to this permit: <br /> • No portion of any structure, including retaining walls,may extend closer to the <br /> OHWM of Benoit Lake than 75 feet. <br /> • No grading or filling may be done within 50 feet from the OHWM of Benoit <br /> Lake. <br /> • Slope in the walkout basement area is in excess of 20%. Any grading or fining <br /> done beyond the minimum necessary required for the excavation for construction <br /> of the house will require a grading permit from the Zoning Department and <br /> review and approval of erosion control and soil stabilization methods by the <br /> Burnett County Land Conservation Department. <br /> These conditions are consistent with our discussion at my onsite inspection and <br /> establishment of the setback limit.
