You would have two options for the <br /> deck area: <br /> 1) Simply remove it completely <br /> 2) Apply for a separate"Gazebo Permit",with your Land Use Permit application, meeting the following <br /> criteria from the Burnett County Code of Ordinances: <br /> Sec.30-513. -Slructutes exempted from setbacks to ordinary high-water mark. <br /> C <br /> Stmctures exempted from setbacks to ordinary high-water mark of navigable waters as per Wis. Stats. § 59.692(ly)provided: <br /> (l)The part of the structure that is nearest to the water is at least 35 feet landward from the ordinary high-water mark. <br /> (2)1 he total floor area for all structures in the shorcland setback area of the property does not exceed 200 square feet. In <br /> calculating this square footage all portions of all existing structures not meeting the required shorcland setback will be <br /> counted except permitted boathouses and stairways/walkways. <br /> (3)1h structure has no sides or has open-screened construction. Knee walls of 32 inches or less will be considered open <br /> construction.The color of the structure must be earth-toned. Its roof is present it must be a pitched roof, with <br /> maximum height of 12 feet(as measured to the peak)with maximum overhang of24 inches. <br /> (4)]he property owner has an approved plan to restore and/or preserve the shoreline vegetative buffer zone as per section <br /> 30-505.This plan most be approved by county meeting shoreline buffer restoration/preservation standards,a shoreline <br /> vegetative buffer restoration/preservation agreement must be recorded with the county register of deeds,and the <br /> restoration plan must be implemented prior to permit issuance. <br />
