The submittal has been CONDITIONALLY APPROVED.The owner,as <br /> defined in section 101.01(10),Wisconsin Statutes,is responsible for compliance with all conditions of this petition <br /> approval and other applicable code requirements.Plan submittal and approval to the department or its agent may be <br /> necessary prior to construction undertaken per this petition. <br /> Based on the precedent established by the previous petitions,this petition for variance is being processed as <br /> permitted by Wisconsin Statute s. 101.02(6)(g),and Comm 3. <br /> • Comm 83.43 (8)(i)Table 1: The code section petitioned requires that a POWTS distribution cell(Dispersal <br /> Component)maintain a minimum horizontal setback of 10 feet from any building,water service or private <br /> water main, 5 feet from a property line, 15 feet from a swimming pool, and 50 feet from the high water mark of <br /> navigable waters. <br /> • The variance requested is to allow a POWTS distribution cell to be 40 feet from a lake on one side and a <br /> vegetated lake bed on the other side. <br /> • The intent of the code section petitioned is to provide the minimum horizontal setback distances as outlined in <br /> table 83.43-I as extra safety factors for public health,waters of the state and structures during construction and <br /> in the event of component failure. <br /> The petitioner submitted the SB-9890 application form including a set of POWTS plans for review of the system <br /> and a soil test as supporting documents. <br /> Reviewer's Comments: <br /> 1. The proposed system is 7 feet above the ordinary high watermark of the adjacent lake. <br /> 2. There are at least 66"of unmottled sandy soils at this site.
