Prior to my site visit, as is customary for any landowner, 1 reviewed a file we <br /> have for your property. Our files show the following' <br /> 1) On September 4, 2010, 1 reviewed your property and noted a more or less square section of <br /> retaining wall approximately 3 feet high and spanning approximately 27 feet across your property, <br /> parallel to the ordinary high water mark. At that time I instructed you that I could recommend <br /> replacing this square section of retaining walls because they held back a large area of old fill that <br /> contained maple trees. My determination was that the trees and fill would be greatly compromised if <br /> the wall would be left to deteriorate or was not replaced. Air photos of the property with 6 inch <br /> resolution per pixel,clearly show the location and extent of the old wall. Generally speaking, <br /> the Bumett County Zoning Code does not allow new construction of walls such as this. <br /> 2) On April 5,2012, you stopped at the Burnet County Government Center and spoke with staff in our <br /> office again about wall replacement. <br /> 3) On April 12,2012,I reviewed your file again and sent an email to the Burnett County Zoning <br /> Department: <br /> "Jim: <br /> I met this landowner on site in September of 2010.. At that time I reviewed their old retaining <br /> walls. The walls hold in a section of fill that is very very old and has large maple trees growing <br /> in it. It would cause more damage than good and compromise this already vegetated area to <br /> remove these walls or to allow them to deteriorate. 1 recommend approval of replacing the <br /> existing walls at the same height and foot print as they are now. - <br /> Thanks, <br /> Paul" <br /> It's very clear to me that the additional sections of low wall on either side of your square wall,are <br /> unpermitted structures, based on our records for your property. Additionally the total hard surface area <br /> of these walls creates extra runoff during a rain event and inhibits the easy passage of certain species of <br /> animals that require this near shore area for habitat. Please refer to the"red lines"on your enclosed site <br /> diagram for sections of wall that must be removed. 1 also included a red line where there is about 18 <br /> feet of old timber wall that is badly deteriorating and should be removed as well. <br />
