i1 a � REC .,rD <br /> �g � MAY 0 ' �7Q <br /> AG�RUDMNT <br /> PLUMB'' CTIO'N <br /> This :1GRE12NT, made and entered in this <br /> day of Lt , 197_9 <br /> by and between the County of Burnett, A I�iunicipal Corporation, with rip ncil l <br /> offices t Grantsburg, jisconsin, hereinafter called "County", andLt <br /> _hereinafter called "Owner". <br /> ;SAS, an application has been Heade for a building permit on the following <br /> described property, to—grit: <br /> WIC^SAS, the percolation test for septic tank drainage does not meet the <br /> minimum standards of the County of Burnett and the State of Wisconsin, and <br /> 9HER AS, the owner agree-- to install a holding tank for septic tank purposes <br /> and the Owners are also aware of the fact that sanitary sewer will be built <br /> in the future to service the property above described and that they will be <br /> assessed for the installation of sanitary sewer; <br /> NOW, THCREFORL, for and in consideration of the issuance by the County of <br /> Burnett of a building permit for the above premises, the parties do hereby <br /> agree and bind themselves as follows: <br /> 1. Owners agree that they will conform to all the rules and regulation <br /> of the Sanitary Code of the County of Burnett in the building of their <br /> and septic system including the holding tank. They agree that <br /> anytime the County of Burnett through its Zoning Administrator or Health Officer, <br /> deems it necessary to pump out said holding tank, the owners shall have same pumped <br /> out in 46 hours, or County will have said work done and charge same back to owners <br /> and place same on their tax bill as a special charge. The owners further <br /> agree that the County of Burnett is hereby granted the right, license and authority <br /> to enter upon their property above deccr.bed to inspect, pump and haul, if <br /> necessary, from the said holding tank. <br /> The County of aurnett agrees to pump and transport the contents of <br /> said sewerage holing tank to an appro•red disposal site, Sec. 146.13 and <br /> 146.14 11isconsin ,Statutes 1967, and if the owner does not do so in response to <br /> orders from the County of Burnett as provided by Paragraph 1 of this agreement. <br /> 2. Owners agree that they will pay the special assessment which may be <br /> made against them on said premises above described for their property share of <br /> the cost of the installation of sanitary sewer to serve their property. <br /> 3. Owners agree that they trill not at the time of installation of said <br /> sanitary sewer assert arZr claim as to lack of benefit by reason of the fact <br /> that they have been permitted to install a holding tank; and that they will <br /> be precluded from asserting any defense in that respect as to any charge made <br /> by the County for installation of said sanitary sewer. <br />
