It is clear that the description in this Deed is based off <br /> an unrecorded Plat prepared by Surveyor Walter Hoar from Shell Lake in <br /> 1963 as filed under D-961 at the Land Records Office at the Government <br /> Center in Siren Wisconsin. <br /> 2) The legal description of this parcel (Deed Document#352906) is senior to <br /> that of the parcel lying northerly of said parcel. This parcel was originally <br /> conveyed in a Deed dated May 28, 1976 and recorded in Volume 303, Page <br /> 424; the parcel lying northerly was originally conveyed in a Deed dated <br /> May 13, 1977 and recorded in Volume 313, Page 176, Burnett County <br /> Register of Deeds Office. This research was done by the Burnett County <br /> Abstract Company of Siren Wisconsin. For the reason of this parcel being <br /> senior to the parcel lying northerly,the deeded distance of 100.00 feet was <br /> monumented for the purpose of this Survey on it's west side thereof. <br /> 3) Highway Easement was given for Pepin Road to the Town of Scott, <br /> Burnett County Wisconsin,dated July 15, 1963 and filed for record on <br /> October 19, 1967 in Volume 226, Page 13, Burnett County Register of <br /> Deeds Office. The width of this easement is recorded as 3 rods wide. <br /> 4) There has not been an official decision by the County on the placement of <br /> the Meander Corner on the west side of DuBois Lake on the north line of <br /> Section 34. Surveyor Walter Hoar set a 1 '/4" iron pipe for this Meander <br /> Corner in 1963 and is located 24.96 feet south of a straight line drawn <br /> between the monumented Northeast Corner and North '/4 Corner of Section <br /> 34. It is known that Mr. Hoar used a substantially different position for the <br /> Northeast Comer of Section 34 than what has been perpetuated and <br /> monumented by the Burnett County Surveyor's Office in November of <br /> 1981. (Consult the Certified Land Restoration Sheet for particulars). It is <br /> not know what position Surveyor Hoar used in his 1963 Survey for the <br /> North '/4 Corner of this Section 34. It is my opinion that the placement of <br /> this Parcel, as surveyed, is based on a dependant re-survey of the 1963 <br /> Hoar Survey, his found monuments control. It is also my opinion that the <br /> location of this Meander Corner, if found to be different than that of the <br /> 1963 Hoar monument at his Meander Comer, would not affect the location <br /> of the parcel as surveyed and monumented on this Survey.
