E. Spangberg which is filed in <br /> the Land Records Office for Burnett County,Wisconsin, index number RF 12,Page 147. Parcel number 9 of <br /> Andrew's map is shown as the west 200 feet of Government Lot 1. In September 1957, Spangberg conveyed <br /> parcel number 9 describing it as the westerly 200 feet of Government Lot I. In April 1996 the parcel was <br /> conveyed a second time and described as the West 200 feet of Government Lot 1. In August 1959, <br /> Spangberg conveyed parcel number 8, describing it by metes and bounds and calling for iron monuments at <br /> both ends of the line common to parcels 8 and 9. In addition, the description calls the west line of parcel 8 "a <br /> line 200 feet East of and parallel with the East One Eighth line of said Section 16-40-15...." It is clear from <br /> inspection of Andrew's survey map and the descriptions in subsequent conveyances that the intent was to <br /> convey property as surveyed and represented on Andrew's map. In June 1997 surveyor Krause found two <br /> markers along the line common to parcels 8 & 9 and accepted them as Andrew's iron monuments. He then <br /> placed three intermediate markers on this line shown on Certified Survey Map Volume 16, Pages 36& 37. <br /> For the purposes of this survey I am accepting the 1.315 inch O.D. iron pipe found at the southwest comer, <br /> the steel fence post found at the northwest corner and a 0.84 inch O.D. iron pipe found at the northeast comer <br /> of parcel 9 as Andrew's monuments and representing the intent of the conveyance. On the east line of this <br /> parcel I am accepting two of Krause's markers as perpetuating Andrew's survey line. A found 0.84 inch O.D. <br /> iron pipe at the southeast corner of parcel 9 is slightly off of Krause's line. I believe it is also from Andrew's <br /> survey but is in unstable soils which may explain the difference in alignment on the date of my survey. In <br /> addition to the above observations it is my opinion that the west line of Andrew's plat is a fair quality <br /> representation of the placement of the government lot line.
