Hoffman <br /> 2610 W. 91st St. <br /> Minneapolis, MN 55431 <br /> Dear Mr. Hoffman: <br /> On 8/11/89 I stopped at your property (Lots 7 & 8, Block 4, Lake McKenzie Beach Subdivision) <br /> and looked at your steps and decks going down to the lake. <br /> All structures (anything constructed or erected) except piers, fences and boathouses have to <br /> be 75' from the ordinary high water mark of the lake as per 4.4(1) of the Burnett County <br /> Shoreland regulations. The exception to this is a Burnett County Land Use Committee policy <br /> of allowing stairways and landings as long as they do not exceed 4' in width. The onsite <br /> at your property found two decks/landings which were over 4' in width, with the lower one <br /> being used for purposes other than a landing. <br /> I have recently received some ordinance language dealing with stairways and landings from <br /> the Department of Natural Resources, which drafted these shoreland requirments and <br /> anticipate them being adopted by the county. This new ordinance amendment would allow <br /> one landing of 40 square feet or smaller in conjunction with the stairs. <br /> The decks/landings you have on your lot are in violation of this ordinance, with the deck <br /> on top of the hill being at 63' from the ordinary high water mark of the lake and the deck <br /> at the bottom being only 6' from the ordinary high water mark. <br /> To correct this violation the decks/landings must be removed or altered to meet the <br /> ordinance requirement. Because I am sure that the ordinance amendment will be adopted <br /> the lower deck/landing could be altered to a maximum of 40 square feet and left. The <br /> deck/landing on top of the hill could be moved back 12' or removed. <br /> Please contact me if you have any questions. <br /> Sincerely, <br /> James P.
