Additions and alterations to nonconforming structures <br /> are restricted or limited. <br /> If a structure is nonconforming to a lake setback(75 feet)and closer than 40 feet to the ordinary high water <br /> mark, our ordinance would allow maintenance only. This would allow replacement of siding, roofing, similar <br /> sized windows, insulation, plumbing, etc., but would not allow the replacement or alteration of over 25%of the <br /> structural members. The intent of the ordinance would be to have the structure relocated to a site where the <br /> required setback could be met. <br /> If a structure is nonconforming because other setbacks cannot be met(for example, 63 feet to the centerline of a <br /> town road, 40 feet to a wetland, 10 feet to a side lot line, etc.), additions and alterations are limited and no more <br /> than 50% of the current fair market value. <br /> FEMA and the State of Wisconsin have also provided Burnett County with floodplain maps indicating areas <br /> subject to flooding. Any proposed additions or alterations to a structure shown to be in the floodplain would <br /> also be subject to restrictions and or flood-proofing. Modifications and/or additions could not exceed 50%of <br /> present equalized assessed value unless the entire structure is elevated to floodplain construction standards. The <br /> elevation required is 2 feet above the required regional flood elevation. You would be required to provide the <br /> existing ground elevations determined by a Wisconsin licensed engineer or surveyor. <br /> If the proposed project does not meet the above criteria we cannot approve permit applications. The ordinance <br /> does allow for an applicant to apply to the Burnett County Board of Adjustments for a variance to the Land Use <br /> Ordinance. Enclosed is a variance application for your review.
