K #102 <br /> Siren, WI 54872 <br /> RE: Linahon Property <br /> Dear Mr. Buchholz: <br /> Our office has been retained by the Linahons with respect to the alleged shoreland zoning <br /> violations on their Burnett County property. It is my understanding that you are requiring <br /> a restoration of their property to the Burnett County ordinance standards in accordance <br /> with a letter issued on July 24, 2015. In particular you are seeking a 50-foot deep <br /> vegetation protection area and a single viewing/access corridor up to 30 feet wide. The <br /> development work on site which triggered your letter was observed by you in your site <br /> investigation conducted on July 17, 2015. <br /> Based on my review of recent legislative changes, Burnett County cannot require the <br /> restoration of the vegetative area. Wis. Stat. § 59.692(lf) was created by 2015 Act 55 <br /> which became effective July 14, 2015. It provides as follows: <br /> (If) (a) A county shoreland zoning ordinance may not require a person to do any of the <br /> following: <br /> 1. Establish a vegetative buffer zone on previously developed land. <br /> 2. Expand an existing vegetative buffer zone. <br /> (b) A county shoreland zoning ordinance may require a person to maintain a vegetative <br /> buffer zone that exists on July 14, 2015, if the ordinance also does all of the following: <br /> 1. Allows the buffer zone to contain a viewing corridor that is at least 35 feet wide for <br /> every 100 feet of shoreline frontage. <br /> 2.
