51 OF
* BURNETT COUNTY
LAND & WATER CONSERVATION DEPARTMENT
7410 County Road K,#109
Siren, WI 54872
COUNTY Telephone: (715) 349-2186 Fax: (715) 349-2102
LWCD@burnetteounty.org
September 8, 2010
Bryan and Joan Sommer
72535 County Road 21
Fairfax, MN 55332
Dear Bryan and Joan:
On September 2, I reviewed your property on Devils Lake in Burnett County for a Land Use Permit—Gazebo.
My review is to see that you have an intact shoreline buffer between the cabin and the lake that meets the
Burnett County Shoreline Buffer Standard. I have enclosed a zoning booklet explaining this. You are allowed
to cut and mow an area 30 feet wide to access your dock, the rest of the buffer, extending back 35-feet from the
ordinary high water mark is a"no-touch" zone.
I noticed a few issues with your buffer that need to be addressed to be in compliance with your permit:
1) Lots of cut trees and dead wood—Dead wood inside the "no-touch" zone should be left alone, there is no
cutting allowed within this area, with the exception of ONLY your access/viewing corridor
2) Bare soil—all areas of bare soil should be permanently vegetated, including any areas within your access
corridor, these you can stabilize with lawn-type grasses.
3) Install silt fence—there was no silt fence installed for the additional basement excavation!!
Your permit is conditional upon meeting the requirements listed above. If you have any questions, please do
not hesitate to give me a call at the number listed above.
Sincerely,
Paul D. Cook
Conservation Specialist
