CONCLUSIONS OF LAW <br /> THE VARIANCE MUST MEET ALL THREE OF THE FOLLOWING TESTS: <br /> A. THE HARDSHIP IS DUE TO PHYSICAL LIMITATIONS OF THE PROPERTY RATHER THAN THE <br /> CIRCUMSTANCES OF THE APPELLANT BECAUSE: <br /> OF EXISTING ROAD LOCATION AND EXISTING GARAGE/GUEST CABIN <br /> C. THE VARIANCE WILL NOT BE CONTRARY TO THE PUBLIC INTEREST AS EXPRESSED BY THE <br /> OBJECTIVES OF THE ORDINANCE BECAUSE: <br /> STRUCTURE WILL NOT FURTHER ENCROACH ON ROAD RICHT-OF-WAYSTRUCTURE IS AT <br /> DEAD END OF ROAD AND APPLICANT WILL NOT BUILD ON LOT 13.
