FINDINGS OF FACT <br />7. Ken Erickson has filed an application for a peril to replace a wooden retaining wall <br />with rack riprep and repair existing rock riprep on Me banks of Sand Lake, in the Town <br />of Jackson, Burnett County, also described as being in the NEI/4 of Me NW1 /4 of <br />Section 25, Township 40 NOM, Range 15 West. <br />2. The project will consist of removing the wood at the shoreline now and replacing with <br />rock riprep and repairing the existing rock riprap along the remaining shoreline. The <br />total amount of shoreline is 220 feet. The area above the ordinary high water mark <br />will be re -vegetated wish native plantings. <br />3. The Department has completed an investigation of Me project site and has evaluated <br />the project as described in the application and plans. <br />4. Sand Lake is a navigable water. <br />5. The proposed project, If constructed in accordance with this permit will not adversely <br />affect water quality, will not increase water pollution in surface waters and will not <br />cause environmental pollution as defined in s. 283.01Sort, Ws. Stats, <br />8. The proposed project, K constructed in accordance with this para will not adversely <br />affect wetlands. <br />T. The Department of Natural Resources and the applicant have completed all <br />procedural requirements and the project as perinsd will comply with all applicable <br />requirements of Sections 1.11, 30.12(3), Wisconsin Statutes and Chapters NR 102, <br />103, 150, 299, and 328, of Me Wisconsin Administrative Code. <br />8. The structure or deposit will not materially obstruct navigation because the rock will be <br />placed against the existing bank. <br />9. The structure or deposit will not be detrimental to the public interest because fish and <br />Wildlife will be able to access Me shoreline after Me wood is removed and the rock <br />and native plantings are placed, and the rack and plantings will help prevent soil from <br />washing into the lake. <br />10. The structure or deposit will not materially reduce the flood flow capacity of a stream <br />because the rack will be placed against the ebstirg bank and not create a dam or <br />impoundment in Sand Lake. <br />
