I enclose a copy of Certified Survey Map No. 1984, Volume 11, Pages 45 and 46. I <br /> also enclose a judgment I obtained in a quiet title action about one year ago. Basically, <br /> Mr. Richard and his associates own these lots, as well as other parcels. Their proposal is <br /> to re-survey these lands and create two parcels out of the existing four. I enclose a tax <br /> parcel map, which outlines their proposal. <br /> We need some feedback from you in regard to Outlot 1. As you can see by the Judge's <br /> decision, Outlet 1 is titled in an associate of Phil Richard by the name of Gregory J. <br /> Phillips and is determined to be free from any rights other than utility easements of <br /> record. <br /> I asked Jerry Hansen of Burnett County Abstract Company to research the issue to <br /> determine whom, if any one, had rights to Outlot 1. His research showed that in the past <br /> this general area was subdivided into eight parcels, which included seven Certified <br /> Survey Map lots along the Yellow River and an 11-acre parcel, which also had some <br /> frontage on the Yellow River. When these parcels were sold, only one of the parcels was <br /> granted a 1/9`h interest in what would ultimately be Outlet 1. That conveyance was <br /> recorded in Volume 390 at Page 186. When that parcel was re-sold in 1996, the <br /> document did not convey the 1/9h interest in what is now Outlot 1. Therefore, no one has <br /> any rights to access Bass Lake through Outlet 1. <br /> We, therefore, feel that extinguishing the Outlet as part of the re-survey should be <br /> acceptable.
