Zoning Committee Meeting <br /> July 5, 2005 <br /> Page 4 <br /> Mrs. Medaglia has decided to apply for the rezone versus the conditional permit. There <br /> would be three duplex (two-family) dwellings on the 7.7-acre parcel. There would be <br /> one storage building and there would be access to Devils Lake. All setbacks will need to <br /> be met from the lake, pond, lot lines, town and county roads. They proposed to have <br /> access off of County Road A. Whatever is noted on the plan is what is being approved at <br /> the rezone request. <br /> No comments were heard or received. <br /> Public hearing closed. <br /> Motion made by Sybers to recommend APPROVING this rezone to the County Board, <br /> second by Falk. Motion carried. <br /> Plat Review: <br /> Bass Lake Acres <br /> The preliminary has been reviewed. This is a 14 lot county plat in Swiss Township. This <br /> is a proposed 66' wide easement road off of N. Bass Lake Drive. Motion made by <br /> Anderson to approve this final plat, second by Sybers. Motion carried. <br /> Other Business: <br /> Doug Crane, Surveyor, and his client, Marvin Swangstue, were in asking the Committee <br /> about redoing a survey. Mr. Swangstue is in the process of selling his vacant lot and the <br /> adjoining lot (which he used to own) has the garage built over the lot line. Mr. Crane <br /> would like to adjust the lot line around the garage on a new survey. Mr. Flanigan says <br /> that he cannot just approve a new map showing a new lot line as it reduces the lot width <br /> below minimum requirements. Mr. Flanigan suggested Mr. Swangstue apply for a <br /> subdivision variance. Mr. Crane read an Attorney General's opinion regarding <br /> exemptions on sale or exchange of land. Mr. Crane believes that he should be allowed to <br /> adjust the lot line without going through the variance procedure. The Committee directed <br /> Mr. Flanigan to seek Corp. Counsel advice. <br /> Mr. Flanigan had questions on a subdivision variance that was granted in 2003. The <br /> variance was granted to create two lots and no more than that. Somebody bought the <br /> whole piece of land and would like to create two lots, but with a different configuration <br /> than was shown on the variance application. Can this be done? The Committee directed <br /> Mr. Flanigan to seek Corp. Counsel advice. <br /> Office Business: <br /> Motion made by Sybers to approve the vouchers, second by Anderson. Motion carried. <br /> Motion made by Sybers to adjourn, second by Anderson. Motion carried.
