BURNETT COUNTY ZONING ADMINISTRATION
BURNETT COUNTY GOVERNMENT CENTER
7410 COUNTY ROAD K,#102 PHONE(715)349-2138
SIREN,WISCONSIN 54872
May 20, 2002
David Phillips, Asst. Attorney General ...
State of Minnesota
Office of the Attorney General
525 Park Street, Suite 200
St. Paul, MN 55103-2106
Dear Mr. Phillips:
I received your letter dated 5/8/02 regarding the Eagle Pines property.
Our Land Use/Zoning Ordinance does not allow for lake access easements unless the
easement is through a lot which meets the minimum lot width and area for the zoning
district and lakes class. Wisconsin State Statutes Chapter 30.133 also restricts use of
easements for dock purposes.
Our Subdivision Ordinance requires all new condominiums to meet the minimum
shoreline density requirements for each lakes class, Yellow Lake is a Class 1 Lake,
which requires 150-foot lot width and 30,000 square-foot lot area. This property only has
enough frontage for two dwelling units.
I have enclosed copies of our Subdivision and Land Use Ordinance dealing with condos
and easements.
Please contact me if you have additional questions.
Sincerely,
Ia )j 11"
Ji Flanigan
Zoning Administrator
JF:mb
