Meyer, Secretary <br />Telephone 608-266-2621 <br />Toll Free 1-888-936-7463 <br />TTY Access via relay - 711 <br />WISCONSIN <br />DEPT.OF NATURAL RESOURCES <br />2018-NOEE-Webster Motel <br />Burnett County <br />SUBJECT: NOTICE OF VIOLATION AND ENFORCEMENT CONFERENCE REQUEST <br />Dear Mr. Vasatka and Mr. Taylor: <br />The Department of Natural Resources (department) has reason to believe that the demolition and disposal <br />activities, by property owner Vasatka Enterprises, Inc and demolition contractor Taylor Excavating, Inc., of the <br />former Webster Motel located 26480 Lakeland Avenue, Burnett County, Webster, WI is in violation of Wisconsin's <br />asbestos and solid waste regulations. These alleged violations are based on an investigation by the department <br />and inspection of the property above by the department on November 29, 2017. <br />Based on the information gathered during the investigation and inspection the department alleges the following <br />violations: <br />Section NR 447.06(1), Wis. Adm. Code - Demolition and renovation; applicability. Pre -inspection. To determine <br />which requirements of this section and ss. NR 447.07 and 447.08 apply to the owner or operator of a demolition <br />or renovation activity, the owner or operator shall, prior to the commencement of the demolition or renovation, <br />thoroughly inspect the affected facility or part of the facility where the demolition or renovation operation will occur <br />for the presence of asbestos, including Category I and Category II nonfriable ACM. No thorough asbestos pre - <br />inspection was conducted prior to the structures being demolished. <br />Section NR 447.07(1), (3)(a), Wis. Adm. Code - Demolition and renovation; notification requirements. Each <br />owner or operator of a demolition or renovation activity to which this chapter applies shall: (1) Provide the <br />department with written notice of intention to demolish or renovate. (3)(a) At least 10 working days before <br />asbestos stripping or removal work or any other activity begins, such as site preparation that would break up, <br />dislodge or similarly disturb asbestos material, if the operation is described in s. NR 447.06 (2) (a) or (d) 1. If the <br />operation is as described in s. NR 447.06 (2) (b), notification is required 10 working days before demolition <br />begins. No notification requirements were completed prior to the structures being demolished. <br />Section NR 447.08(1) Wis. Adm. Code - Demolition and renovation; procedures for asbestos emission control. <br />Remove all RACM from a facility being demolished or renovated before any activity begins that would break up, <br />dislodge or similarly disturb the material or preclude access to the material for subsequent removal. All RACM <br />was not removed from the building before the demolition activities. CAT 11 ACM was rendered friable (RACM) <br />during demolition of building.
